Earlier today I received a very worrying email from the Association of Art Historians concerning removing the copyright exception for taking photos in public space. If this passes, one consequence is that we in principle can no longer freely share images of street art or buildings on social media.
Please take a moment to read the below, and do sign the petition if you feel that your right to freely publish photographs taken in public space is worth preserving:
"The UK and most other EU countries currently enjoy a copyright exception for photography often referred to as โFreedom of Panoramaโ. This exception enables anyone standing on public ground to freely take and use images of buildings and works of art. It is a very good thing for AAH members, who use such photographs in our research, lectures and publications, but it usefully serves everyone who likes to take and share photographs.
This exception is now set to disappear due to an attempt to harmonise European law. Instead of expanding the Freedom of Panorama to all European member states, which was the original intent of the proposal, an ill thought-through amendment to the proposal may now take it away from everyone.
We recommend two ways for you to take action: You can sign this online petition; and you can write a short letter to your Members of the European Parliament (MEPs).
You can find out more about the Freedom of Panorama here. The EU makes the full proposal available online. The relevant section is paragraph 46.

New book out now - "The Street Art World", by 11 on Jun 30, 2015 15:39:53 GMT 1, I cannot believe what I have just read - this is astounding and would put an end to many of the aspects of street / urban art scene that we enjoy so much. can you imagine seeing and experiencing some of those beautiful pieces and never being able to share them with anyone even if it was your own photo.
The ramifications of this are huge and should not be allowed to happen, this isn't just street art but photography of everything and anything that would have buildings, art, i guess even privately owned landscapes - would kill the selfie culture but don't think i can sacrifice everything else just for that - petition signed

I see what you mean, and perhaps AAH are painting the picture a bit more grim than it really is.
The problem is, however, that removing the exception would make it a matter of defining what "commercial use" is. For example, is a street art blog that runs advertisements a commercial outlet? Is my Instagram account, which I sometimes use to promote my work, a commercial outlet?
For academics the question is particularly pertinent. Is the use of photographs in academic books, which are commercially available but rarely make any money, to be considered commercial?
While the removal of the exception would of course not in practice prevent everyone from posting photos on social media (this would be impossible to police), it does make the legal standing less clear for those who take images in public space and choose to share them with others.

Journal of Art History just published my article "Carelessness or curatorial chutzpah? On controversies surrounding street art in the museum".
The article is mainly about Art in the Streets (2011), including the BLU mural controversy. This case was also discussed in my book The Street Art World from last year.
I have linked to the publisher's full-text version of the article from my Academia page. Unfortunately the article is not currently open access on the publisher's website, but I am hoping that it will be eventually.

In honesty though I found it pretty hard going at first as it's very academic and has lots of big words But that's what makes it a little different, it's an in depth look at our obsession and works very well as opposed to just lots of pictures.

Last year I posted about this upcoming anthology dedicated to graffiti and street art and also promised to post updates as the release date of the book approached. It was originally planned for a late 2015 release, but by all accounts it will now be published in February or March 2016.
I have written one chapter for the book, entitled "Stealing from the public: the value of street art taken from the street". This text expands on the theme of removing and trading in artworks from the street also discussed in the third chapter of my book The Street Art World.
