Warning Ebay selling and buyer, by jopie505 on Feb 22, 2016 15:47:46 GMT 1, Hi everyone,
Here to warn you about Ebay, and an ebay user who stole my D*Face Statue of Liberty after an auction.
I would like to share this experience with you.
The buyer dazzaq1979 AKA Darren Cooke from Exmouth has won the auction (ebay 221937361667).
After slow payment, I sent him the tube to a shipping address in London.
Within a few days of receiving he sent via the Ebay complaint system me a notification that said that what was receives was damaged and therefore not according the description from the Ebay auction. He suggested in this notification to sent me back the money and he will than sent back the art work, or to agree a compensation.
I replied that this was not true, and asked him for proof. Buyer ignored me since the request.
Ebay agreed with his statement and told me to sent back all the money within 5 working days. They told me that they have no part in re-shipping off the good. Ebay is also not interested in seeing evidence from claim from the buyer.
So Ebay took his site, and forced me to refund the whole amount within 5 working days.
In the meantime seller still ignored my aproaches towards him.
5 working passed quickly, than Ebay (via their direct order to Paypal) collected all the money from my bank account, without giving permission from me.
Still the seller ignored my approaches towards him. Also when I phone him he hang up (via Ebay you can request for contact details, which were btw different than shipping address).
I was still in a 1 direction email discussion with Ebay (everytime another call center member, who does the case all over again (way of ebay to disangouras open cases)) and warned them at the end that they will be involved with the steal of my art work. ebay does give no f/*ck.
Until today the art work has not been sent back, and the buyer hangs up the phone or ignores email.
Gone print and gone all costs Ebay en Paypal still claim for their great services.
Hope this recent (December 2015) experience will help others.
Any thoughts to get my artwork back are welcome.

Warning Ebay selling and buyer, by Goooogle Male on Feb 22, 2016 16:47:49 GMT 1, You must have the buyer's address as you sent the artwork to it... Send him a letter by registered (special) delivery stating clearly the refunded artwork is not legally his as it has been refunded in full and that if not returned to you within say, 7 days from receipt you will begin legal action. If nothing heard, after 7 days just issue a small claims court writ - can be done online for ยฃ50. That will get his attention. If you have to actually go to court you can claim the writ (and any other associated costs) from him. As you have refunded in full it will be impossible for him to win the case and they can issue a CCJ against him. Another option is that as he illegally holds your property (contract null and void due to refund) then you can always make a report of theft to his local police station.
You've given him enough time to act 'decently' now - from here on in, act strongly and decisively and you will get your print back.

The only debate then tends to be around who pays for postage ( which if not as described or damaged the seller is normally liable for )
This process takes weeks rather than days.. so what you have said below just doesn't sound right to me

I would expect eBay to allow the seller time to get back the item before refunding, plus proof from the buyer's side that the item was damaged and shipped back to the seller. The answer is a resounding NO! I recently wrote a post on How Ebay Gives Buyers a License to Steal. I swear to you it's true. Bottom line is don't sell anything on Ebay, especially your art. This post sickens me and I am sorry for your loss. I feel your pain and wish you the best of luck. So far I have had none getting my items back or any of my money that was refunded to the buyer(thief) credited back to my account. I have not given up, but it sure seems like Ebay just washes their hand of their wrongful decisions. I say to all members on this forum FUCK EBAY!!!

I wish it wash true, and Ebay took this responsibility. I could live with that process, but Ebay does not do it that way. I have almost been bagging in emails to all their call centre members, but Ebay is death to this. They did not want to see the proof, thee did not want to give me more time, the did not want to wait for the reshipment before refunding him.

If push came to shove I'd only offer collection only so at least there couldn't be any 'damaged in transit claims'
