Think about the process of cutting a stencil. Why would he create a pixel effect if not intentional? It would take more effort than cutting a straight line, so the steps would be very deliberate. Any argument that it's a result of a blown up a jpeg is odd. How has this not happened in the past if that's the case? I mentioned before that I see the hula girl in the same vein as No Ball Games. Think of it as a take on the hoop and stick game. Children in underprivileged areas making the best of their somewhat derelict surroundings and the discarded bike was a playful way to bring that to life. Perhaps the added pixel effect is an update to the previous message - as someone else referred to them as "digital kids". Whether by choice or more recently because of lock-down, the days of traditional outdoor fun is being substituted with artificial fun over social media (I still see a Facebook logo in her hair). Team Banksy obviously felt they had a reasonable chance of GDP resulting in a successful trademark defence, but it would have been a calculated risk and the lawyers would have known the outcome was uncertain. These things happen because the law is interpreted by judges based on often conflicting precedents and legal arguments, and because they have the ultimate power to interpret it as they see fit. The bottom line is that obtaining the best legal advice and following it to the letter is no guarantee of a successful outcome. It was clearly a publicity stunt with a "what if" potential. If he really wanted this, a store a la "emin international" could have been opened, selling cheap tat for a year or two.

However, the facts of this matter are wholly unique in the following ways: 1) Banksy was trying to trademark work that he originally created, which was appropriated for a use he never intended. If someone trademarks your work to make crap you would never make, is it fair to force you to make crap in order to protect your original work? 2) Like I said, these rules are meant to prevent trademark hoarding by those who see the future value of possessing the intellectual property and the exclusive rights to an intended use. They are not meant to force the commercialization of appropriated creative work. 3) The standard for meeting “intended use” is so minimal that I am more than sure banksy thought GDP would fulfill this requirement. The issue is whether or not he actually intended to use the trademark for products. He did use it. How he used it doesn’t matter so much. How many people got ‘products’? Maybe if the shop was run like a shop he’d have a case. But his disclaimer section basically said the buyer was a schmuck and he could send them something or not. Judge seemed to rule the ‘shop’ wasn’t a shop. And that’s the reality.

I criticized that aspect from the onset. I however was pleased as it lasted so long and turned into a full functioning hotel and not just a PR stunt or grab the attention spotlight for a short amount of time. It aged well and I changed my mind about it. And yet here you are.
