Banksy has just done a straight drawing of loads of cuddly toys in a cattle truck. Copying it from the person who originally came up with the idea, by driving a real truck full of toys around in a cattle truck. Thats the theft here. Not what Gonefellows has done. Similar I suppose to Banksys take on 'Winston Churchill', which I love. Gonefellows art is original IMO. If he wanted to print it and make some money from everyone that likes it I can't see where the problem is. I think is a great gesture offering the image for all to print. I would get your copies, while you can.

Actually I had been off the radar for ages and haven't even seen any of the stuff from New York. Pretty funny mistake I guess. I have just searched BOTI New York images and 'voila'. In that case Gonefellows is a very naughty boy and should be punished. Actually I like all like your take GF and think its a great gesture offering the image for everyone to print. Re-photography uses appropriation as its own focus: artists pull from the works of others and the worlds they depict to create their own work. Appropriation art became popular in the late 1970s. Other appropriation artists such as Sherrie Levine, Louise Lawler, Vikky Alexander, Cindy Sherman, Barbara Kruger and Mike Bidlo also became prominent in the East Village in the 1980s.
There was some info online that by using someone elses photograph of a painting etc or someone elses image as in JPG etc that they created.
It's classed as theft unless you actually take the photo and create the JPG yourself.
There is also a thing about referencing the original source of an mage,
For example the truck cab and chassis in Gonefellows picture being taken from the truck cab and chassis in the Banksy original.
So if these new versions or prints are sold, does Banksy have a claim on any money as a percentage?
Also if they are re sold by Flippers or others in the future what would be the situation.
Banksy doesn't need the money and the Gonefellow version does not detract and is not detrimental to Banksy's image.
If Banksy has given permission, then in the future some re sellers could advertise this print as a colab between Banksy and Gonefellow.

I would look to the most recent ruling if you are U.S.-based which is the Richard Price case. the case dealt with work that Price created wherein he took another artist's photographs and transformed them through the use of blue paint splotches on the images. The appeal and subsequent ruling stated that artwork that uses others' images only needs to be transformative, not necessarily a commentary on the original subject matter to constitute fair use.
