It's classed as theft unless you actually take the photo and create the JPG yourself.
There is also a thing about referencing the original source of an mage,
For example the truck cab and chassis in Gonefellows picture being taken from the truck cab and chassis in the Banksy original.
So if these new versions or prints are sold, does Banksy have a claim on any money as a percentage?
Also if they are re sold by Flippers or others in the future what would be the situation.
Banksy doesn't need the money and the Gonefellow version does not detract and is not detrimental to Banksy's image.
If Banksy has given permission, then in the future some re sellers could advertise this print as a colab between Banksy and Gonefellow.

The appeal and subsequent ruling stated that artwork that uses others' images only needs to be transformative, not necessarily a commentary on the original subject matter to constitute fair use.
