Think you will find that all of Martins work regardless of what you think does not legally infringe the photographers copyright
There are also some loop holes that Kostas Seremetis found in the 90's in regards to using comic characters etc as reference. Interesting stuff but the breakdown is, if you hand paint it as a one of a kind and change it just enough, its yours.
Chevrier and the collage is fine. Just like selling second hand comics is fine. And also if Kostas' research is correct, her hand painting the collage should be fine as well.

Anything comic book related is what sells these days. What if she took those comic collages out, would people still but her work?. The only reason why I have her work is because of the comic collages and at the time it only cost $200-300 for an original. I probably wouldn't buy one at the prices now. But that's just me.
She found her gimmick with the comic collages as Martin Whatson with his squiggly tags. They will both ride that gravy train until it breaks down. And you can't blame them for that.

Is it right to use it, who knows. A lot of people sell fan art of copyrighted images for profit. DC/Marvel(Disney) will only start to take notice once she starts to make millions from it. Then they will tell her to stop or make her give them a piece of the profit for using their images.

Just pointing out she only started to get recognized when she used comic book collages on her paintings. Take those comics out, you get another painter who paints nice portraits. The comic books is what sets her apart form other portrait painters. Is it right to use it, who knows. A lot of people sell fan art of copyrighted images for profit. for example work in the public domain may not have copy right protection.
there are also exemptions from the base copyright rule. Thing called fair use.
copyright can also be time consuming and expensive to protect particularly if your an artist and it is not the most valuable piece and the infringer is in another country.
one of the exceptions to the copyright rule is transformative work. Which is what Martin would claim in this case in that although he started with the original image what he ended up with is actually his own unique artwork. Which is what happened in the Richard Prince case someone mentioned earlier.
so regardless of what people think and shout about it...I would tend to believe that in a copyright law case they would probably side with Martin in that he transformed the work but I could be wrong on that which is why the copyright rule is a pain I the arse to manage particularly in the art market as it is very subjective

Thing called fair use. copyright can also be time consuming and expensive to protect particularly if your an artist and it is not the most valuable piece and the infringer is in another country. one of the exceptions to the copyright rule is transformative work. Which is what Martin would claim in this case in that although he started with the original image what he ended up with is actually his own unique artwork. Which is what happened in the Richard Prince case someone mentioned earlier. so regardless of what people think and shout about it...I would tend to believe that in a copyright law case they would probably side with Martin in that he transformed the work but I could be wrong on that which is why the copyright rule is a pain I the arse to manage particularly in the art market as it is very subjective |

Her biggest contribution: adding comics to portraits... They're nice... Her artistic skills are not out of this world... Some of us are fan-boys, some of us are not. I actually prefer Sylvia Ji... But being the poor sod that I am, cannot afford her OGs... But do own two of her giclee prints. However- beauty (read: art) lies on the eye of the beholder... Cheers! You draw a smiley face and i will copy it by drawing it. this is not copyright infringement as i will draw it with my own hands. you take a photo and i will scan it in and print it out and add tags to it. this is copyright infringement as i have not reproduced the image with my own hands. hopefully that explains it.

Copyright is infringed by copying. Copying in relation to an artistic work means reproducing the work in any material form. In both instances you are reproducing the work, albeit by different means. The means of the reproduction is not the deciding factor - it is whether a substantial part of the copyright work has been reproduced. So assuming there is copyright in the smiley face (and there are reasons why there might not be) - copying it by hand would be an infringement. But just because an infringement occurs does not mean a law suit follows. This is highlighted by the fact that, until 1 October 2014, if you copied one of your CDs to your computer to play in iTunes for your own listening pleasure, that would have been an infringement of copyright. So technically, there were thousands of infringements occurring everyday. Were rights holders interested in pursuing these types of infringement? No. They are more concerned if you make the contents of your iTunes library available to others to download. |

Music on the other hand is ran by corporations and music publishing houses.....they have lawyers and legal departments coming out of their ears. Also the people infringing are either no bodies in which case they watch and care little or they are signed to another large publishing house or a large record label who have s**t loads of money and can pay big sums for any copyright infringements that they make.
So as usual is controlled by economics as opposed to right and wrong.
Ps Rene's problem was probably the fact that he knicked it from someone else!!!!
