He offered refunds after Banksy said he wasn't involved, but said he would collaborate with another artist and the money would all still go to charity. He also said that whoever stuck with him would be rewarded with a $5,000 print for $100, which he later raised to $500. We all know how that turned out. None of these things are related. The original shirt sale (the "100" Faile/Invader/Fairey shirts) were not limited, but anyone who wanted a refund got one. I know several people asked for a refund, got one, and didn't have to send back their shirt. Delivering a half-assed shirt is not fraud. It's just delivering a s**tty shirt. Wasn't the original purchase page a shirt with a question mark on it or something? That's like buying a "mystery" tube from an artist and getting crap. I have not seen one person in this thread saying they asked for a refund and didn't get it. Got a post to quote? AFAIK anyone who asked for a refund got one. If you didn't like the charity shenanigans you were free to get your money back. I personally bought a Faile scuba horse shirt and kept it.. whatever it didn't go to charity, but I still have my shirt that I am fine with. Also, Paypal's window running out does not limit your options - you could still file a chargeback, call your bank, etc. Just to be clear, this way this guy has done business is really dumb and shady, but if he actually took people's money (as in, someone asked for their money back and didn't get it), this thread would be more along the lines of the recent thread about the artist who didn't deliver the OGs. I don't think you're paying very close attention to what you're reading. The first section you quoted was in regards to the Banksy shirts, not the Ivader, Obey and Faile shirts. That's why it Says Banksy and not any of those other names.
To your comment, however, they very definitely were sold as limited edition shirts. When they didn't sell out immediately, people knew something was up, including Faile. They asked that COAs be included with the orders. They printed and mailed the COAs to BNE well in advance of him shipping them. He agreed to include the COAs and then didn't.
He claimed he didn't include them because he didn't feel comfortable using the water charity's name on the COA. This is despite the fact he used their name liberally on his website and social media before, during and after he refused to send the COAs. So if you believe that excuse, I don't know what else to tell you.
Printing and selling more shirts than the advertised limited quantity is fraud. That said, that wasn't the fraud I was referring to in my post, so let's move on.
Regarding the half assed shirt being fraud, I never said it was. In fact, if you read the very next sentence after the section you quoted, I said the opposite. It was dishonest and an all around dick move on his part, but probably doesn't cross the threshold of fraud.
As for refunds after the fact, he did not issue any refunds. A few members posted on here that they asked for refunds and were ignored. If you can point to anyone who asked for a refund and received it, I'd like to see it.
Regardless, collecting money in the name of a charity and then keeping it is fraud no matter how you spin it. Even if he did issue refunds when asked, it would still be fraud. If you don't believe me, go door to door collecting money for the Red Cross and keep it. Then when the police come knocking on your door try telling them you would have given the money back to anyone who asked.

Facts being how much money was raised for the charity and what happened to the money.
Otherwise it looks like he is being evasive.
Also people have a right to know seing as it was a public campaign to raise money for charity.
The other stuff to do with merchandise and refunds is up to people who placed orders as to if they are happy with what they paid for or not.
It's very simple really and BNE should have published a few facts.

I interpret that to mean he didn't have anything to do with it. The only other possible interpretation I can think of (that a handful of people actually made) is that Banksy did have something to do with it and this was part of an elaborate hoax to reward people who cared more about giving to a charity than about getting a Banksy shirt.
Even if you thought that was the case at some point, I think it's fairly obvious by now that Banksy never had anything to do with it.

It's a fact he sold hundreds of shirts at $100 a pop. It's a fact Banksy said he never had anything to do with it. It's a fact BNE said he was scammed in a series of bizarre and contradictory claims. It's a fact BNE said he would partner with another artist and give all the money to charity. It's a fact he never partnered with another artist. It's a fact he ultimately didn't give the money to charity. Based on all of those facts, myself and quite a few others have speculated that BNE is a lying piece of s**t and has lined his own pockets in the name of charity. Come to think of it, that last bit isn't so much speculation as it is fact. Not arguing but this is wrong. "It's a fact Banksy said he never had anything to do with it." he said the T-shirt was not his, and never mentioned a history of anything. But regardless, I feel bad for anyone who bought his print. he dug a big hole here... I was paraphrasing, of course. His exact words were, "Banksy has not made any t-shirts for a water charity." I interpret that to mean he didn't have anything to do with it. The only other possible interpretation I can think of (that a handful of people actually made) is that Banksy did have something to do with it and this was part of an elaborate hoax to reward people who cared more about giving to a charity than about getting a Banksy shirt. Even if you thought that was the case at some point, I think it's fairly obvious by now that Banksy never had anything to do with it.

This print was an inferior up-sell on the xbanksy tee. what's next? I'm guessing the allure of something even better, but that goes nowhere. I'm pretty sure sales books have been written about this, but BNE likely hasn't read them. He has an amazingly intuitive grasp of the fundamentals of social influence - see, for example, the foot in the door technique.
