ebay fakes - you might not get money back , by dashboll on Mar 2, 2015 20:35:13 GMT 1, Hi all, posted a while back about buying a fake peter Blake on ebay, wasn't fretting because I knew I'd get a refund, but just got a message from PayPal refusing the claim because the item was "as described". I'm gutted, don't have much cash and me and the missus wanted his I love you car boot print since it was released. Quite a lot of money now lost. Thanks to the members who sent pictures to show this was fake (signature was printed rather than in pencil) but wanted to warn that you might not be covered on eBay if buying a fake.
Had the word "style" in the description and guessing this is what caused the problem. Alright if a tenner, but not the amount I paid.

Peter Blake owns the copyright so the item listed was a fake and also in breach of the artists intellectual rights.
Style of is still in breach of copyright laws and just as Ebay remove fake Kalvin Kleins and Moody stuff it's the same with art.
I doubt the seller was authorised by Blake to sell copies of his prints.
So style of if unauthorised is not a get out clause

It's in their interest to back you up.
If they do then go to small claims court for your money back. I doubt the seller would turn up.

Have you tried that? Yes dashboll, don't just take their first response. They have a duty to protect from fraud or purposeful deception. This is all just semantics and wouldn't stand up in a court of law. It's like any big company (I've dealt with more then a handful (councils, banks, B&Q)) their first tactic is always to claim non-fault. Then it will finish off with them saying it's company policy not to go to court and here's a cheque for xxxx.
The one thing I'd massively push back on is the heading - "Limited Edition Print" [How is the print you received characterised as a limited edition print? If only numbered from original print then it's a copy of a limited edition. Just for a starter...]
Have they taken down the sellers account? I'm keen to look at their other listings. B)

I remember seeing the original listing on eBay a few times and thinking it looked a bit odd, bad photo, with strange colours and a lack of information. Not that I really have to say or want to rub it in but people really do have to watch the 'too good to be true' listings. Although I don't remember this fitting in to this cataegory as it was priced fairly in the market for this Blake print. I've made a few gambles in the past which have paid off but equally ones I have claimed my money back, but you do have to be extremely careful with certain wording used and probably best to steer clear in those cases.

What did the seller say when you told him/her it was fake and you wanted a refund? didn't contact the seller as it was a fake went straight to paypal.

Peter Blake owns the copyright so the item listed was a fake and also in breach of the artists intellectual rights. I doubt the seller was authorised by Blake to sell copies of his prints. You won't believe it : I paid mine 540ยฃ - just after seeing Exit - and I dunno if it s real or not - even if it is , I will never sell it for this price, with no COA etc... I was really stupid ( I think that the seller asked some mates to put bids to increase the price ) , not stupid, but innocent as a young kid wanted his toy. I bought 5 fake Bznksy road signs too ( cheaper anyway around 150 quids ) .. And the sellers are still on eBay ! The only thing that Ebay can do Is, after too much claims, ban the seller. Ask Patick Nguyen about fake Banksy , he worked with SYard, the men were arrested and EBay did not have any probs. they were not treated as receivers because of their warning ... 540 quids for a tenner ! That costs 10 in the current life !

Arguing again that the item is not as described will end in the same dead end .
However arguing, with proof, that this product is illegal and in clear infringement of copyright law should get you a favourable ruling as eBay will not be keen to explain why they play a role in such a transaction and collect a fee from it.
Don't give up, you will end up winning.

It may be worth pointing out the misuse of the word, the fact it is not signed, pointing out the purposefully confused description is fraud may get you a second look, but knowing paypal I doubt it.

the small claims court is the final option - there is probs 99.9% chance that the seller will not contest it and you will be awarded in default if you have organised your case properly - got any mates who are lawyers ?

Been in touch with paypal a few more times, they've told me to contact bank which Ive now done. I paid through PayPal direct from my bank, so it's actually classed as a direct debit. Under the direct debit guarantee the bank has reversed the payment so now got it back.
PayPal have advised that they won't contest it (but I'll have to wait and see if that's the case).
It means however that the shit who sold this still gets his (or her) money, so no doubt will try it again.
I was a fool I know, he had low feedback (none neg) and should have seen warnings, but I always thought you'd be covered by PayPal so no risk, obviously this isn't the case.

The words FAKE and THIEF go a long way to damage reputations especially concerning art sales, and also warns other potential bidders.
