Just based on the possibility of it tarnishing their name in the art community, which a fashion forward brand would want to try to avoid, after seeing how wrong it can go like with H&M which was a much more obvious rip and got way more press. But time will tell...

Heโs rightfully looking to protect his IP. Good on him for standing his ground against a mega brand too lazy and cynical to come up with something original while looking to cash in on a trending hype train.
Stick to the shitty Supreme colabs.

Futura ๐บ๐ธ Leonard Hilton McGurr โข New York Graffiti Artist, by dani on Jan 14, 2021 19:54:25 GMT 1, In order to successfully claim copyright infringement, Futura would need to show not just that the logo is similar to his design, but that it was derived from his design. Unless there is evidence of North Face's artist being very familiar with Futura's work, I think the logo is generic enough that it can't be assumed up front that it wasn't independently designed. Just Google "squiggly circles." It's not that special.
And Futura definitely can't trademark the word Future. He could trademark the atom "logo" if it were recognizable enough, but I'm pretty sure it's not. Especially when North Face is operating in an entirely different market.

I was expecting to see his signature style printed all over. But the lockup referenced is a bit of a reach imo. Plus you only have to alter an original design by 25% to be considered unique in the eyes of the law. Hence why all those venders can use trademarked logos on their witty gag gift t-shirts.

The reason street vendors can use trademarked logos is because it's arguably parody / fair use, but as a practical matter the real reason is Starbucks isn't going to take the time to sue every random guy on Canal Street making a Starf*cks t-shirt. But I guarantee you that if a major coffee shop chain started using a logo that was 75% of the Starbucks logo they would be sued for copyright and trademark infringement.

I work in the creative industry. Its more a rough rule, I think its actually the 30% rule - though its also a bit of a falsehood as we would never actually be taking a copywrite protected work and altering it. I believe the actual laws are pretty vague, it has to change 'enough' from its original form - but that is up to interpretation.
You must not be familiar with Dumb Starbucks! www.theguardian.com/commentisfree/2014/feb/12/dumb-starbucks-trademark-lawyer
Also a slew of other trademark infringement that was dismissed for Starbucks alone. www.darts-ip.com/starbucks-logo-battle/

It discusses parody and fair use, and also explains that the decision by Starbucks not to sue was largely a pragmatic one. If rather than a parody lasting a few days someone had tried to establish an ongoing, legitimate, profit-driven coffee shop chain called Dumb Starbucks, I guarantee Starbucks would sue and win.
As to those lawsuits in the second link, I'm not familiar with Korean, Japanese, or Indian IP law. The Starpreya logo in particular is fairly egregious and I'm confident would not survive a trademark infringement lawsuit in the U.S.

The Atom on itโs own shouldnโt be a problem either? Putting them together is very naive on the designers part as I canโt imagine anyone that high up in a creative industry that wouldnโt at least be aware of Futura.

So he is happy to make money off the back of North Face when it suits him; but not when he wont make any money.ย How does that tie in with your comment "he is never in it for the money"? ย On a more general note, doesn't everybody rip off everybody else on the urban art scene? ย (think Mickey Mouse, Simpsons, Warner Brothers cartoons, Pink Panther, etc. etc. etc.) ย The list is almost endless.ย
because they worked together in the past doesnt give them the right to use his design in perpetuity. and when he was actually contracted with them, he has creative oversight to use his name/likeleness how he wants. completely different.

He's not some new jack on the scene, he is building a legacy and the problem that has been around graffiti for FAR too long is that people don't give it(or the artists) the respect it deserves. Corporate entity after entity has tried to make money off of the back of it(graffiti) for street cred or the cool factor, but if any artist tries to stand their ground it's selling out or some bullshit like that.
As far as this comment someone else posted above "On a more general note, doesn't everybody rip off everybody else on the urban art scene?"
No, everybody doesn't rip off everyone. Toys and clowns rip people off. People rip off Futura because he is an original
