UK Import Customs Charges 🇬🇧, by sleepyl on Apr 7, 2021 11:28:25 GMT 1, Hi guys,
I am not sure if this is actually only relevant for France but here's my issue.
Context: I got two paintings sent from Singapore to France. Those are originals / unique editions. The tax that should apply is 5.5% and there should be no custom fees as per our "article 278 du code général des impôts".
Issue: the sender attached a picture of the paintings and an invoice stating "wood paintings". And you know what happened... DHL did not apply the right code and charged me 20% + custom fees. Obviously I had to pay the full amount first or they would send it back to Singapore. Only then would I be able to raise my claim, which I did i.e. I sent 3 emails, called numerous times only to being told after a-month that: (1) they applied 20% as there was not enough information to classify the parcel correctly and apply the right custom tax code, stating that the invoice should state "unique edition 1/1" etc. (2) I had to pay €50 if I wanted to raise the case with the french customs so I can get part of my money back.
Has anyone had any similar issues? Wtf do we have to pay those €50?
Thanks, Sleepyl

UK Import Customs Charges 🇬🇧, by Poster Bob on Apr 7, 2021 11:39:35 GMT 1, I would have sorted out the reduced charge over the phone/email before paying. Once they get your money they have no incentive to care.
I highly doubt that the tax code indicates that it has to be "unique 1/1" or anything similar to qualify for reduced VAT. Page 14 VERY CLEARLY SAYS "WORKS OF ART". They don't have a leg to stand on. Anyone with half a brain knows that a painting is art.

UK Import Customs Charges 🇬🇧, by sleepyl on Apr 7, 2021 12:19:15 GMT 1, Thanks both.
Who is charging you 50 euros? DHL or the french customs? That is outrageous! You shouldn't have to pay anything to get a refund. DHL is charging me 50€ to raise a claim ... regardless of what french customs end up deciding. The weird thing is that the guy from DHL is telling me it would not be "judicious" to go ahead. I mean ... wtf? This is none of his business, unprofessional and he's not providing any evidence. I should be getting ~ 87€ back and that guy is telling me that's not judicious, wtf? Since I never heard of those 50€ before, I asked them to provide their terms and conditions where this is stated. Hopefully it won't take another month for them to get back to me.
I tried to reduce it over the phone before I paid. They told me (1) it was not possible, (2) that I had to pay the full amount or the parcel would be sent back to Singapore and (3) that I could only do a claim after I paid it in full. I am well aware they are wrong but my concern is that the ppl I've dealt with at DHL only have half a brain, which is not even functionning properly...
I don't know what to do.

mrizzle had similar issues with this charge, see bottom of this thread. urbanartassociation.com/thread/169305/paul-inscect-avant-launch-allocation?page=7 I'm not sure how they get away with it. At the very least the fees should be refunded if it's a successful appeal imo.

UK Import Customs Charges 🇬🇧, by Poster Bob on Apr 7, 2021 13:26:42 GMT 1, To be fair, it really depends on the agent. I remember having problems with a collection from Artnet where the DHL rep demanded and EORI number and wouldn't listen when I said I didn't need one. Artnet had to have their DHL contact step in and tell the employee to ship the print ASAP without it.
It helps to stay polite, control your tone and have proof that you're in the right.

UK Import Customs Charges 🇬🇧, by artzzzy on Apr 7, 2021 14:54:28 GMT 1, This same scenario happened to me so many times here in Italy too :/
The problem is you have to pay the higher (wrong) taxes and then complain about it, and there’s no clear process here to get your money back.
I learned from experience that I shouldn’t wait for the shipper to go through customs clearance.. because once they start this process (with the wrong info) it’s very hard and time consuming to sort it out.
once the item is shipped I contact the courier and send myself and send them the documents and declarations explaining that it’s an art piece and should be taxed as such.
For important pieces if you’re using a specialized shipper/art delivery service they know what to do on their own. But if you’re using Fedex/DHL/UPS directly you have to hold their hands to make sure they don’t fuck it up.
At least it’s like this here in Italy.

I have over 10 unpaid invoices for Fedex. I rang/emailed many times and told them I won't be paying until they send the correct invoice amount.

UK Import Customs Charges 🇬🇧, by Lroy on Apr 7, 2021 17:02:32 GMT 1, I had a similar issue with DHL in the Netherlands, but we quickly sorted out things via email and they charged me with the right amount using the reduced VAT rate. So surprised to see how it's handled in France... As i said last week, I have paid 48 euros for DHL - from UK to France, for 4 mini prints at 30 quid. It's a rob. Never I will buy again
( on the sticker it has been sent in "economic " postage, and I think there are some arragnemetns between art dealers, galeries and shipping companies ) I even don't know if I has teh rgith to claim and where ?
( in fact they lie too, package was already in my tow, - as I paid i got it in my home 2 hours lalter - and on the mail package was still in Bruxelles and reday for delivering 3 days after the notification ?! DHL is using gangsters and small robbers, times ahs changed )

UK Import Customs Charges 🇬🇧, by sleepyl on Apr 7, 2021 17:11:41 GMT 1, Ok, so quick update: (1) Despite being calm they won't budge and still ask me to pay €50 if I want to raise my claim. The €50 is actually part of their "Clearance Data Modification" customs services, available here in english (£45) mydhl.express.dhl/gb/en/ship/customs-services.html
(2) they're telling me that moving forward, I need to ask for detailed invoice, mentioning this is a signed piece of art, a certificate of authenticity, a full description of the artwork and so on ... what the hell???
(3) I have tried the polite "can I speak to the manager/supervisor?" card ... I am still waiting for someone to call me back.
It may look like organised scam to me but suuurely I am missing something...

UK Import Customs Charges 🇬🇧, by artzzzy on Apr 7, 2021 18:09:55 GMT 1, Unfortunately this is typical delivery company attitude.. They don’t care and don’t have time to lose because the problem is not theirs. They got payed for their service and for the custom clearance.. The taxes is always the problem of the customer :/
Here in Italy they accept a declaration that I prepare and sign myself instead of the detailed invoice, COA etc.
I think this situation with shippers and customs got really worse with COVID and the increase of their volume of work.
I currently have three packages “lost” in the customs offices (since Jan)! I supplied all the documents but they still haven’t cleared customs and nobody knows where they are exactly!!

Yeah UPS with me as well, can't get back the extra duty at the moment

It may look like organised scam to me but suuurely I am missing something... What courier companies like DHL fail to appreciate is that we are paying for their service, often named as "processing fee" or "brokerage charges". In other words, they are being payed to deal with import / custom charges and problems that may arise. Their job is much more than just delivering a parcel from A to B. They need to start taking some responsibility. If DHL asked me to pay 50 Euros to make a claim I would tell them to f**k off! I would then make a formal complaint to their head office. I'd say they are also being paid by governments to collect the duty in the first place (I could be wrong), so why should we pay an extra fee for DHL/UPS to collect it.
If we buy a print for a grand then it should be duty on a grand not duty + a fee

UK Import Customs Charges 🇬🇧, by artzhole on Apr 27, 2021 12:03:47 GMT 1, Hey everyone, bought a hand printed limited edition signed print from France and have been charged £200 import charges by DHL. Does anyone know how you claim some of it back? I should have paid 5% but have paid 20% thabks for any advice :-)
Hi, the same thing has happened to me, just received a customs duty bill from DHL(uk) for £250 (the artwork cost me €800) so I'm not paying that.
...so something has gone wrong there.
Iv emailed customer services twice but had no reply.
How did you get in touch with them?.. ..did they correct the mistake?
If anyone can give me some advice I will be so so soon grateful.
Cheers

UK Import Customs Charges 🇬🇧, by laughn0w on May 10, 2021 19:33:15 GMT 1, Hi all. In order to ensure getting an incorrect VAT bill (as some users in this chain unfortunately have!) is this the correct code I should ask the gallery to quote when sending it? Its a painting being sent to the UK.
www.trade-tariff.service.gov.uk/commodities/9701100000#overview
Should the VATR 03001 also be included?
Thanks!

UK Import Customs Charges 🇬🇧, by John The Badgers on May 11, 2021 18:52:23 GMT 1, It may be worth keeping on top of Fedex/TNT?
I was speaking to them today, and they advised they are way behind on sorting Import Duty issues.
Not art, but we import items from the EU and the Far East through work with Fedex/TNT, and we are waiting for Import Duty Invoices from March.
Speaking to our Account Manager today about it, and he admitted they have big issues dealing with everything, biggest issue he mentions is vendors putting the incorrect tariff codes, causing the tail backs.

UK Import Customs Charges 🇬🇧, by ecudat on Jul 15, 2021 18:26:14 GMT 1, Hey folks, Still can’t score a Martin whatson on a graffitiprints drop, nor seemingly win a lottery for a chance to buy an expensive man toy, however, I have just received a refund, adjusting the vat to 5% on my last purchase. Couple of emails telling me I was wrong. Sent them invoice from gallery, delivery note & invoice with correct vat code & backed it up with copy of regs from gov.uk. Took 4 weeks. Keep at em.. What is the correct VAT code then?
Is it 9701100000? Or 9702000090? Even with those it says 5% or 20%, so how do they know/decide when to charge 5% and when 20%?

UK Import Customs Charges 🇬🇧, by danny2400 on Jul 15, 2021 20:00:43 GMT 1, Last one I had a problem with was the later 9702000090. Haven’t had an issue in a good few months. Sender has to give over a bit of info with regard to what’s in the package, which I assume,....determines which category it comes under. You still arguing the toss?

UK Import Customs Charges 🇬🇧, by amputeerich on Jul 15, 2021 20:18:19 GMT 1, Hoping someone can help, recently got the Katherine Bradford hand embellished print from USA and was charged 5% import charges by UPS which I promptly paid and received the package. Two days later I received a revised invoice for an additional £220 which now works out as 20%. Has this ever happened to anyone before? Must I pay it and if so can I claim it back? Thanks all!

Two days later I received a revised invoice for an additional £220 which now works out as 20%. Has this ever happened to anyone before? Must I pay it and if so can I claim it back? Thanks all! UPS are hopeless! I've been battling with them for over 3 months to sort out import VAT issues. Quite frankly, they don't know what they're doing. Tell them it was an original work of art and ask them to send you an art declaration form. Fill this in and they should agree to the 5% charge.
Thanks very much. I’ve already received the art and paid the 5% so now that I have a revised invoice for 20% (minus what I’ve paid) I wasn’t sure whether I could just chin it off and forget about it or whether I should pay it and then try to claim it back from HMRC. UPS are saying it’s not them charging, it’s HMRC who have done a revised invoice. So confused.

UK Import Customs Charges 🇬🇧, by Wanchope on Oct 30, 2021 17:42:08 GMT 1, Hi All, I’m sure this topic is boring as fxxx, but just bought a print from NYC to be delivered to her in the UK. I’ve asked the gallery to put the right code on so I don’t get hit with another 20% tax bill. It is being delivered via fedex. They have said they use code 9702 but could put 9701 if that helps. Anybody have any experience and will I get lumbered with a 20% bill either way?? Cheers all

The general rule of thumb is that limited edition prints (provided they’re hand pulled screenprints but a slightly grey area) are eligible for the reduced 5% if imported under the correct code. However, it does need to be clearly stated on all the relevant paperwork.
“ Goods classified under heading 9702 include:
original engravings prints lithographs
These goods must have been produced in limited numbers and exclude those made by mechanical or photomechanical processes.”

Thanks mrizzle

Thanks mrizzle "print" isn't enough. Use "Hand-pulled limited edition screenprint, tariff code 9702000090"
