TateWard β’ Art Auctions π¬π§, by daniel3886 on Sept 15, 2020 11:09:36 GMT 1, The original thread seems to have disappeared (not at my request), I wanted to update members here on the outcome of the situation.
Following discussions with our legal team and consigner the following offer was made to the winning bidder yesterday.
βWe will complete the sale if we receive cleared funds by 5pm on Wednesdayβ
The buyer has decided not to proceed. This closes the matter from our side if there are any further questions Iβll be happy to answer them here or via mail Danny@tateward.com.
We have thousands of satisfied customers, inevitably there will be the a small number of times when issues occur. We will always work to resolve these amicably and to the satisfaction of both sides and if that requires us to make a profit over reputation choice weβll choose reputation every time.
Consignments for our next sale (Oct 14th) close 23rd September so please send any works youβd like to consign to Harry@tateward.com

TateWard β’ Art Auctions π¬π§, by reg on Sept 15, 2020 13:12:22 GMT 1, I've no horse in this particular race but am genuinely interested in what happens in a scenario where a seller withdraws after the hammer or the buyer fails to pay.
It must happen, without going into the specifics of this thread is there an industry wide protocol / approach?

TateWard β’ Art Auctions π¬π§, by Graham H on Sept 15, 2020 13:39:42 GMT 1, I have no affiliation with the Auction House.. but id say that it appears that they have at least offered a solution rather than use legal excuses or ignore a genuine situation..
They at least gave the winner the option and i may be wrong but looks like the timescale would still be longer than he had to pay when winning originally.. and for some reason he chose not to take it forward..
Cant do any more in my eyes.. other than learn a lesson and therefore with those learnings hope not to repeat the situation

A solution entirely on their terms isn't working towards an amicable solution with all interested parties. In my humble opinion it shows how little they value the customer who through no fault of his own was originally screwed over. The best way to right the wrong would've been to talk it through together like grown ups and come to an agreement.

Pay or don't pay.
Seems like it was the seller that caused the main issue, not the auction house. They just tried to resolve it, but then the buyer didn't help himself by being a bit awkward. Just an unfortunate set of circumstances, that probably won't be repeated again.

TateWard β’ Art Auctions π¬π§, by coller on Sept 15, 2020 14:03:13 GMT 1, it seemed like the auction house caused the problems. and it seems like the auction house is supposed to be the middle man between buyer and seller, but is mainly operating to benefit the seller here.

TateWard β’ Art Auctions π¬π§, by 18921892 on Sept 15, 2020 14:15:42 GMT 1, It's a bit rich for the potential buyer to come on here and moan about the auction house, then they work out a way to sell the piece to the seller and they don't want it. What a waste of time for everyone, possibly didn't have the money or buyers remorse that's why they were messing about with credit cards.

I think the issue is βCleared payment by 5pm Wednesdayβ had they not given the print back to the seller, theyβd have likely had cleared funds from the buyer by now. Now the deals suddenly potentially back on and he has to scramble - not to get funds sent - but to have them cleared? Heβs in no control over that, they may as well have said bank transfer only.

Or someone who doesn't want to hand over their hard earned to an outfit who acted unprofessionally in the 1st instance and who then did little to resolve 'amicably'.

TateWard β’ Art Auctions π¬π§, by NYart on Sept 15, 2020 14:38:09 GMT 1, Wire clears in one day.Β Buyer should have been prepared to wire funds fully after winning.Β Asking to put that much money on a credit card is nonsense. Depending on what points he collects it would be enough points for two free 1st class tickets to somewhere nice. Its certainly not βnonsenseβ , I charge anything and everything the vendor and my limits will allow. Zero benefit for the buyer to use wire, debit, or cash.
All my point is, people are suggesting heβs a tire kicker, canβt afford it anyway etc. They initially OKβd credit and now the βresolutionβ is necessitating a wire transfer. That and the house giving back the seller their print before the payment deadline had passed are the only two relevant facts in my eyes. The rest is speculation and finger pointing.

TateWard β’ Art Auctions π¬π§, by T-Bro on Sept 15, 2020 14:47:17 GMT 1, My Experience with Tateward has been faultless as a buyer and a seller. From my perspective, they have given me the white glove treatment and I am not on the top of either category.
Knowing Danny and his team they would have done everything they could to sort out the situation and keep all parties happy.

TateWard β’ Art Auctions π¬π§, by Lazarus II on Sept 15, 2020 14:49:32 GMT 1, I have to admit, I'm rather confused by this. Is Daniel the buyer and is now publicly moaning because TateWard didn't give him enough time to complete the purchase? Who's who in this? And what exactly is the problem? Daniel is part of Tate Ward.
