As per the t&cโs you canโt get a refund on the NFT, only the physical.

Damien Hirst H10 โข The Empresses, by jamesd on May 18, 2022 11:55:25 GMT 1, Now that I own the NFT instead of the physical, I asked Heni how the VAT will be calculated. They couldnโt tell me at the moment, seems theyโve not decided on which sum the vat will be calculated on, initial eth exchange rate, rate that I bought at, or rate at date of redemption for the physicalโฆ. If I recall the original price at issue was 2.1ETHโฆ.? So I figure at worst itโs going to be same vat amount I paid on my original physical orderโฆ..700 USDโฆ However, Iโve still saved over ยฃ1400 (less the gas fees) and I like the artwork, so Iโm rather happy with myself as itโs my first foray into NFTโs.

True. However this was a timed edition. The best way for fans to buy art.
The NFT thing has wrecked this.

Then ones I was looking at on the OpenSea were far cheaper than the Palm/Heni ones. Are you looking on the Heni website? For some reason the OpenSea prices haven't been updating for the last few weeks. Look on OpenSea directly.

The NFT part of the Empress IMO was more interesting then the art itself. I think we will see a lot more releases like this and so we should. Why send work all around the world to sit flat files, under beds and pay for inferior post and risk loss or damage when you could get it held and shipped to the end user when they want it. The transfer of ownership and COA are another thing that needs to start getting picked up on in this space. It was peoples absolute greed and misunderstanding that wrecked this one, the use of the technology should be applauded.

Damien Hirst H10 โข The Empresses, by Greyhound on May 18, 2022 20:52:14 GMT 1, I think the NFT deed is a neat idea. I don't agree that print-on-demand solves the same problem, as the NFT deed release allowed Heni/Hirst to sell the entire edition in one go and pocket the cash. Then, they can take a cut of secondary too. It feels like it should be a big win for them as the primary. Where this has 'gone wrong' is arguably in a few places:
1. The crypto market is weird. In some corners, there is so much money sloshing around that some NFT buyers are happy to sell at a big loss and move on to the next moonshot opportunity. On the flip side, there's been a bit of a rout on various corners of the crypto market recently and it's easy to imagine some people simply needing the cash so they're dumping their NFT deeds as there's a non-crypto market for these, unlike jpegs of monkeys and other 'proper' NFTs. So, we've seen a significant drop in price, to way below the primary market price. This seems unprecedented for a signed Hirst.
2. Supply chain issues have meant that many physical buyers are sat with nothing at all. The volatility of ETH, and recent (lesser) moves in forex have meant folks have cancelled physical orders (distance selling regulations force this for physical, but not for digital items) and can make arbitrage plays via the NFT marketplace.
I'm absolutely not a crypto bro. I've never dabbled at all, and find the environmental impact absolutely horrifying. However I do think the NFT deed idea makes sense as it puts immediate money in the hands of the primary artist/publisher and also makes for a safer secondary market.
I'm still hanging on for my physical. I was tempted to do the arbitrage dance as there was probably ยฃ1000 or so in it at one point, but I'd probably have made a mess, and I suspect the time has passed now anyway.
I'd not be surprised to see other releases use the NFT deed. Perhaps next time physical will be taken completely out of the equation though, and/or editions will be limited by number, not time, so conversion to physical can be immediate.

I don't understand why you think an NFT deed is required to put money in the hands of the artist. When I bought my Magnum photos during the week they were on sale in March, I knew I would not recieve them for months. They did not need an NFT deed to sell them that way. They just needed to specify that the prints would be sent months later. They still took my money.
Why is an NFT deed needed for this process? Companies have been taking payment and delivering at a later date for many many years.

Itโs beyond genius that Heni/Hirst can get a commission from secondary sales before the physical item has even been created.

Companies have been taking payment and delivering at a later date for many many years. To be clear I don't "think an NFT deed is required to put money in the hands of the artist". Putting money in the hands of artists has been solved in many ways for many years. However, the NFT deed is definitely improving the experience on secondary - as others have said the deed guarantees a pristine copy of the work on redemption - and I am arguing that this will surely help the primary sell the edition out very quickly.
Really I guess it boils down to "Heni realised that flippers are gonna flip, and they've leaned into it hard with this strategy, as it allows them to sell out instantly, make extra money on secondary and also incentivise flippers to bite as they don't need to worry about VAT or storage".

Not sure, although I got a refund back in March (pre any delay announcements) but that led me to getting an Empress via NFT and a Currency (substantially more money than the former), so hopefully they are smart enough to see that one can lead to another.

Damien Hirst H10 โข The Empresses, by klyde on May 20, 2022 7:03:17 GMT 1, Wonder whether Heni is keeping a shit list of those who asked for a refund for future applications. No skin off my nose so I don't care, but it wouldn't surprise me.
A shit list?
For simply canceling a purchase per their own terms and conditions?
You're over thinking this.

Damien Hirst H10 โข The Empresses, by michaeldee on May 20, 2022 8:20:20 GMT 1, no screenshot here, but I did watch the auction wind down live. There were 2 last minute bids which extended the sale for a few minutes but then it quickly petered out. IMO, this particular artnet auction was a complete bust...very few bids through out the entire sale. Pretty sure the hammer for Suiko was $4900?

It wouldn't surprise me at all. It's not their own terms and conditions, it's a consumer right. Heni are trying to run a business and the refunds will cause them a huge headache, as well as losing out on a load of money.

Damien Hirst H10 โข The Empresses, by klyde on May 20, 2022 9:35:12 GMT 1, It was a timed release. They want to sell as many as possible. And they sold a shitload.
Cant see why they would want to create a banned list of clients from that.
