1) if you resell an original bought from a primary source over £650 then you need to pay a commission if a gallery or agent helped you sell it. That seems to have implications for ebay if they are considered an agent.
2) If you use the image of the artist you need to pay a fee. Just like you really should if you photocopy a book. The only way around this i can see is if you only use photo's of the print on your wall. Therefore you own the copyright and yet you get to show an image of the print, like people do on ebay, with a bit of wall and frame.
Its seems online gallery's need to take wholesale unadulterated pictures of prints down or cough up or use their own photo's quick smart, from my understanding..... or get permission.

to be fair, he only sold one painting in his life, hardly likely to lead him to a life of riches!

Artist Resale Right finally became law in the UK on 14 February 2006.
The resale royalty right will give artists the legal right to receive a small share of the profits made on the second and subsequent sales of their works, during their lives and for 70 years after death. The UK Parliament will legislate to give living artists this right by 2006 and, by 2012, the right will be given to the estates of artists who have died within the previous 70 years".
