how illegal is street art and what are the laws?, by ร
gentรacardi on Mar 16, 2011 18:50:17 GMT 1, I have a question that I've been wondering about for a long while now... WHY is Shepard Fairey not afraid of showing his face? I mean, everybody KNOWS that he's the guy behind all his work, that he's OBEY... if street art was so illegal, then I'm sure if the police wanted to nab him, they'd have done so by now (if they can track a child pornographer hiding behind a computer, I'm sure they can track Fairey down with ease). Of course, I'm not at all saying that I'd like that to happen, but I'm just wondering why he's managed to stay (relatively) out of trouble for so long? Why do artists like him get to 'walk among the people', while others like Invader or Banksy have to hide who they are?

how illegal is street art and what are the laws?, by Replete on Mar 16, 2011 21:32:15 GMT 1, From what I know he's been arrested a few times for it (whilst in action) but it's because of his medium being pasteups it's classed as flyposting which is dealt with as a fine if at all and he's not short of cash.
Banksy and Invader don't really need to hide their identity it's just part of the mythos that adds to their allure to some people.
The authorities in most western countries only put in serious detective work in regards to graffiti when it comes to painting trains and to a secondary extent painting the railway infrastructure. After that comes prolific bombing on city property.
Street art seems to be overlooked or not classed as a priority to investigate for most authorities probably down to it's public friendly appeal whereas graffiti bombing is demonised by most in power.

how illegal is street art and what are the laws?, by BlightSociety on Mar 17, 2011 9:08:10 GMT 1, True, police only have limited resources and they will tend to target those doing the most financial damage to property. So flyposting and stencilling normally are of low interest where as heavy bombing and rail based crime get most of the in-depth investigation.
But you cant get investigating and interested confused. Just because they donโt have the money and manpower to start a man hunt on everyone who ever hit streets donโt mean they donโt have a thick file of evidence at the station waiting for you should you slip up.
Get caught in the act and all your past work could come back to haunt you. and if you hang around with train writers or anyone else whoโs involved in more serious illegal activity itโll only give them more of a reason to look into your business.

how illegal is street art and what are the laws?, by anewspace on Apr 5, 2011 14:52:12 GMT 1, In Ireland , on private property there has to be a complaint before charges are made. So should the artist get questioned by the police and gets to the owner first - to get the Ok or remove the work no charge is made. However if the artist is drunk or high , (happens more often then your think) the cops can summon for drunk and disorderly.
Caught on public property your just done.
But its often a question of politeness and timing.

Unbelievably long punishment, but the judge has a point about the fact that, that type of graff "artist" doesn't shit on there own door step. Shows he knows its wrong when hes doing it.

how illegal is street art and what are the laws?, by nickster on May 27, 2011 14:56:49 GMT 1, I think its hypocritical that people can sell a graffiti'ed pice of wall and its perfectly legal, which you would say from someone thats opposed to graffiti art is encouraging the "crime" why is selling stolen goods illegal when you actually know their illegal yet you can sell a piece of wall that you know was illegal in its concept ?

Because we live in a free world, where people can not be imprisoned for thinking.

Where does thinking come into it; guy sells stolen jewellery in pub gets arrested and charged with selling stolen goods (ie illegal goods) as can't prove their his goods or obtained them legally, guy sells graffitied wall, guy can't prove that he knew or knows the artist and therefore given permission, so shouldn't the piece by the same thought be considered illegal ?

Stolen goods, are always stolen goods. If a bloke is running round with a pick axe ripping down art, he's gonna be in trouble... but why should someone get in trouble for selling a wall they own ?
I shouldnt have to know the artist to sell my own wall (ownership is the thing here) If someone gives you stolen items, you have no right to ownership as its never been yours

how illegal is street art and what are the laws?, by johnnyh on Dec 29, 2011 17:56:13 GMT 1, Same as always Ned to be careful here that the debate is not on Banksy, Eine and Sheperad F. TOX is classic example of graffiti law. Similarly most people caught spraying anything not theirs if identified and it can be proven will get done. Big diff to say a Bristol area that is sanctioned etc or spa e cleared.
Eg you spray my parents house they will be pissed. Look at the removal of the Banksy from the hotel he is being charged. I assume him saying he was the cleaner will not be accepted. It is someone elses property so if they like it fine otherwise they will be happy to support the police. Police will also rightly to be fair nail someone they catch in general or say f off or we will
