SURELY A BALLS UP ????, by mammal2 on Sept 14, 2007 12:20:30 GMT 1, in this kind of a situation, is there any recourse you can have? can you, so-called, force the person to sell at that price? I know theres very little legal about ebay, but
So they set up the listing wrong. 200 for these is madness, and was clearly a mistake. Why would you want to peruse recourse. Only to knowingly rip of a Banksy fan who made a balls up. Bah.

SURELY A BALLS UP ????, by rydal on Sept 14, 2007 23:46:45 GMT 1, I don't know about e-bay rules etc but legally speaking I think the buyers of those prints would have a reasonable chance of enforcing the sales if they were so inclined. If the seller was to be saved he would have to show that the buyer ought to have realised that the price was a mistake, however with these being backdoor prints and with all 4 showing the same price (thereby removing the possibility of a simple typo and indicating that the price had been consciously selected - not easy to accidently make the same mistake 4 times) I think this would be difficult. It is of no assistance to the buyer that he simply undervalued the items. His only saving grace may have been the comment on a couple of them that stated there was no BIN thereby suggesting a possible mistake. The moral issue is another matter altogether and it's refreshing to see a buyer do the decent thing.

SURELY A BALLS UP ????, by semiscottishpete on Sept 15, 2007 10:25:41 GMT 1, Hey chaps thanks for the kind words, especially G & Lesroy. I've sold Chez Semiscottishpete & have moved in with the in-laws, (we're building & could be here for a few years) all my art is in the loft which is fkcuing heart breaking... so I'm selling most of it & will re-buy when I'm able to find some wall space. My mother law (who is lovely) but prefers, shall we say more classic decoration (She said about Napalm: "I can see why you like it, it's very clever, however it will give me nightmares...) So I'm aloud 1 wall in the house, in which I can rotate the few pieces I am keeping... at present I'm showing Mr Koukoudakis.
So to the auction, I use a program called iSale to set up auctions on e(vil)bay, normally smoother than a cashmere cod-piece, I wrote the auctions during the day and set a delayed time for the sales to begin... hence I wasn't around to see the monumental cock up I'd made. I usually start my auctions at ยฃ1 as this seems the fairest way, but I think buyers find the whole thing a bit sus so I thought I'd start them at ยฃ200 this time, any how ticked the wrong box.....
I've emailed messers "Safecrasckers" & explained the balls up, both the buyers were fantastically understanding & I've promised to pop a little something in the post to make up for their disappointment and to thank them for being so damn decent about the whole situation.
3 of the prints are 100% legit, the WSM was creased in transit when I bought her, which meant she had to be bonded, shame but a lovely print, looks great in the frame. Applause was pride of place in my lounge, lovely framing, with the non reflective glass set a few mill away from the print. Naplam is fantastic, lovely mount, lovely frame. Golf sale is the only iffy one, definitely real, however back door and not in great nick, I bought her from the back door brummie last year. Lovely in the frame though.....
So to conclude, my fkcu up, sorry for the disappointment, thanks for the understanding, and many many thanks for the kind words. Love, peace & underpants SSP x
