(long post, but I copied it from another site, so it's a bunch of posts in a thread)
I thought there was a special section on this forum for scams and questionable Ebayers...? no?
Anyway, as many of my posts indicate, I was looking for signed CND forever. I had an unsigned but wanted to upgrade as this is one of my all time favorites. Recently, I thought I had finally found one on Ebay, was in contact with him during the auction and won the auction. The seller was a Powerseller and everything looked pretty legit.
So I pick it up Monday and it's in the smallest, thinest tube like the standard white ones you can grab at a Post Office store. Definately not yazoo and definately not double-tubed. I'm scared to death opening it, but surprise surprise there is no damage to the tube.
The problem is, I open it up and inside there is just a print out with my address on it 'thanking me for the purchase' and a small gray garbage bag....
WTF?!?
No print, no provenace, no receipt, nothing. I checked the Royal mail tracking and it followed it until taken over by USPS. I checked into the insurance for this delivery and here's what the website says.. I'm assuming the seller is still responsible for FULL coverage,...
"How much compensation will I get if my item is lost or damaged? If your item is lost or damaged in transit, we will pay compensation of up to the value of 100 First Class stamps per item upon production of a copy of the certificate of posting and proof of item value. Extra compensation of up to £250 or up to £500 (depending on the country) is available for an extra charge of £2.20 per item (in addition to the £3.70 International Signed For™ fee). "
and to top it off, he only used 11 pounds of the 37.50 pounds I gave him for the postage. So the rest had better gone to the insurance. I don't care that the Royal mail coverage only goes upto 500pounds (IF) he paid the 2.50 extra (which he didn't) I am entitled to the FULL amount 2100GBPs. IMO he needed to refund me and worry about refunds himself.
I contacted the seller and god the standard, 'oh shit' I can't believe that happened response...
I took pictures of the package and sent them to him and for a day or two he acted as if he was going to work things out... I filled out any paperwork he needed me to on Royal Mail but he never refunded me despite me asking him to.
I realized I was very close to that 21 day hold funds period on Paypal so I told him I was going to file a dispute/cliam for my own protection but that I would cancel it at anytime as soon as he returned my money... no response, no refund.
Now, I can't prove he was the scammer though I'll say why I think he is later. But what I CAN call him out on and warn anyone here from buying from him in the future is that the guy supossedly sent me a $3200 print in a single tube that would barely have fit the print had it been in there AND he didn't even insure it DESPITE me paying for insurance as part of the shipping. Who does that? I specifically asked him to double-tube it in our communications.
he did track the shipment (to show paypal it was shipped) but said: "I can only summise that it has been stolen from the tube, I note from your email that there was a waste bag in the tube ? I dont know why as we only put the print / cert / and thankyou letter in there.
I suggest that you contact the postal people your end and lodge a claim using the above number
I have spoken with the UK postal service who have advised that you will need to do this your end , as the insurance will cover you your end."
First of all, he was going to make me recover? the buyer who paid $3200 and got nothing? WTF? Besides, he DIDN'T insure it. How was I going to get anything back?

Anyway, here's when I became suspicious of the seller and I haven't heard from him since.. I told him he should also inform Dora the print number for their records.. and I remembered- in his auction, he stated that he was the original purchaser. Knowing his name and print number we could find out about this seller pretty quickly.
I asked him several times for the print number and never found out, he has refuse to tell me.
Anyway, he claims someone stole it during shipping. Possible I suppose but highly unlikely. all of the little things point to him trying to pull off a scam.
happy ending for me is that I'm getting all my money back, but can you guys imagine the feeling of opening a tube expecting to find your favorite and very expensive (by far the most I've ever spent on a print) artwork inside only to find a mini-garbagebag?!?
I kept looking in there thinking I must have missed it, that it was up against the tiny tube wall...
Anyway- lessons learned:
A) ALWAYS use a credit card through PayPal NOT direct bank withdrawls
B) Just because someone is a Powerseller selling tons of 2 dollar items does not make them trustworthy (in the worst case scenerio) or wise in packing/shipping (in the best case scenerio). Make sure he has refrences selling like items. Even if the seller didn't scam me, he did a piss poor job throughout this whole transaction.

not from the seller, that's for sure..Forget waiting for Paypal to 'decide' you should be responsible and then the possibility that they find for me but seller might have cleared his account (though I believe there was complete buyer protection, which PP would then cover,not sure).... the magic word: chargeback. Having the same Credit Card for 15+ years and NEVER having issues like this (well, I had a cancelation of a flight they covered me ) sure helps.

Either my Banksy was stolen or I was scammed, by mattlan on May 14, 2009 11:39:19 GMT 1, i take it your are in the states and this guy is in the uk mate? my own view on this is if your both in the uk and your dropping over a grand on somthing, you may as well go and pick it up - it's the only way to be sure. whats half a days driving when there's so much money at steak? i dont understand why people dont actually go to pick goods up.
anywayglad you got your money back mate, is it the credit card company that has come through for you then?

thanks, but at this point, I'm a little gun shy on this particular print and any other expensive print I can't pick up in person...I was scared enough when the lady behind the counter pulled out a tiny little tube, but horified pulling out a $3200 garbage bag.
to the person who thought maybe I was in the US... No, I'm in Japan, but have access to the US postal system. Seller was from the UK.
By the way, I took pictures of the tube and bag, if I can figure out how to post them here, maybe someone can tell me if these types of bags are common in the UK, personally, I've never seen them before. They are smaller with a red strip across the top for closing them...

I have always sh1t myself buying expensive items on Ebay and to be perfectly honest once you're talking about spending thousands of £££ or $$$ on an item, I just will not do it. What happened to you is EXACTLY what I'm most afraid of. Thanks for sharing your experience and your advice and I sincerely hope any data you can offer will expose the identity of this seller and make him/her easier for others to avoid. Make sure your Ebay feedback stands out to warn others off as much as possible too!

... your statement above is a pretty sweeping generalisation. I've sold and bought some pretty expensive stuff on eBay and, through taking sensible precautions, always got a good result. I imagine I've also had a good dose of luck, but it would be unfair to label every ebayer on one side of the Atlantic a cheapstake who irresponsibly cuts corners.

sad story.
messy when it's art coming to the us - or for that matter the other way around. protection using pp and ebay / cc is a grey area. currently from what you say your cc company will protect you - in the us - the same does not appear to be the case in uk.
Folks in the uk - take note - if you stump up and it goes pear - your cc company will back away from the table and run. as will paypal your bank and... well you get the jist ...
I was scammed a while back - and had to take pp to the banking ombudsman (don't know if there's an equiv in the us).
Suffice to say it's a messy area and one which one must always proceed with caution over.
cpo / wiz - no name of the seller ? have you complained to ebay / had their membership reviewed ?
Good to hear it worked out - however i still have an uncertain feeling at times when it comes to hearing this kind of story - puts me ill at ease when dealing with the us (in my case) - though have bought a few things from folks over there with no real trouble.
(btw - coa looks sus)

I'm REALLY interested in hearing from someone who owns a signed CND and I want to know what the provenance looks like. Is what was advertised in the auction what you have? Maybe I should have known going in this was a scam...

Notwithstanding that this is a really disappointing result for the buyer and ... - at best, a lesson to the seller to insure properly - at worst, highlighting a seller to be avoided ... your statement above is a pretty sweeping generalisation. I've sold and bought some pretty expensive stuff on eBay and, through taking sensible precautions, always got a good result. I imagine I've also had a good dose of luck, but it would be unfair to label every ebayer on one side of the Atlantic a cheapstake who irresponsibly cuts corners.
