The only way to get around it is to watermark the pictures so it can't be cropped out, which to be honest is a pain in the ass. I've tried reporting for copyright, but unfortunately eBay's system is not great as they only allow you to report and not send a valid reason along with that, also they take action as they deem fit and don't inform you of their decision. Sometimes it works and the item is removed, sometimes a polite pm to the seller works, sometimes eBay doesn't give a monkeys. At the end of the day it's just pure laziness on the part of the seller. I've had this happen plenty of times, even down to the seller copying my description word for word or using my personal photos of events. I would suggest if you haven't, contact the seller politely, asking them to remove all of your photos or you will take action with eBay. If they don't report for breech of copyright or call and speak with someone at eBay which may work better. All you have to do is link the reported item along with your original listing number.

Banksy. They deal with that a lot more quickly than some guy who says his picture was stolen on the Internet.

So think you will find that he/she has every right to use that picture for illustrative purposes. He no where states that this is a picture of the actual piece and never states it is his/her photo.
