I've bought a piece last year and wasn't aware from the seller that this was part of the deal ,consequently I intend to sell and the gallery has contacted the auction house to remind them of the agreement , Not sure where any of us stand ?

Hmmm... IANAL and not sure where youโre located. It could be that payment constitutes acceptance of the terms of sale, but I couldnโt say for sure. Maybe someone on here is better versed.

If you buy it from someone , this someone was not honest with you (and maybe aware about this non flipping rule ) The non resell agreement is to avoid flippers. Because of flipping some real collectors can't even buy from some artist ex (Amoako Boafo). And finally i'm sure Catawiki and Ebay don't really care

I would think being the second owner means youโre in no way bound by the terms of the agreement.

Unfortunately as far as I know it doesnโt matter if youโre the first or second owner.
These standard agreement usually state that if the gallery finds the work on sale within X years of purchase, They have the right of first refusal to buy it back at โfair market valueโ.
Even if they canโt enforce resale rights in the uk, major auction houses wonโt take it.. or will remove the lot if they get contacted by the gallery.
