They are doing a SMUDGE and selling prints and posters of street art... There is a big hoo-haa about them in Berlin at the moment...

Dear Press & Media,
A group of berlin based streetartists asked me to pass you the following information. Itยดs about the conflict between the streetart scene and the company "citygroove.de" which seems to have escalated far beyond the controversy in the net.
Since a while Citygroove is selling postcards, magnets, posters and calenders with art and designs of public works by the majority of berlins streetartists via Internet and in 4-5 different Shops they own in Berlin named "Buchbox". Previolsy the company neither asked for permission nor allowed the artists to participate on the generated profits. The artists consider this as violation of their intellectual property rights and the commercialisation of their artform.
After the artists vented their anger about the exploitation of their art in different blogs and homepages in the net the owner of citygroove.de threatens them to take legal steps and to reveal their real identities to the officials.
This clash with citygroove is already much harder and more emotional by now than the one about the "Urban Art Guide" by adidas last year. Personally iยดm not sure how to end this dispute in peace as there already have been colourbombs and massive threats. As citygroove.de doesnยดt sell his products in Berlin only, but also distributes his urban art prints & posters etc. in Paris, Barcelona, Budapest & London it can be assumed that these cities & artists will be envolved in the conflict soon.
My hope is that this argument looses a lot of its aggression through a public Discussion and objective report, because last but not least itยดs about the central question: Who owns street art?
Within this mail you find links to the blogs and homepages, where this conflict blazed up in the last days - the owner of citygroove wants to institute legal proceedings if these comments arenยดt deleted within the next 12 hours, please judge yourself: (sorry most of the comments are in german)

If that is the case then they should take a long walk on a short pier, plain and simple. Make your own stuff up and make your own way in life, basically get some balls and do the right thing, remember karma is a bitch.

...first victory!!!... citygroove.de shut down their homepage today! - its seems like they feared legal proceedings in germany, because though streetart is illegal, the commercial use of reproductions of temporary art in public space is absolutely against german law and against the law of most european countries!!! Please check:

(Christo won his case against some postcard guys who tried to sell photographs of his "wrapped reichstag" years ago..)
so please , if you donยดt want your own works to be mixed up with horrible designs and sold for 2.99 in every tourist-shop around the corner, stop this guy from his plans & tell your friends...

The "panorama freedom explicitly permits taking pictures or creating other images (such as paintings) of buildings and sculptures which are permanently located in a public place without infringing any copyright that may subsist in such works, and to publish such images. BUT: If a work is presented on a public place temporarily (and street seems to be very temporarily to me), one may be obliged to get the explicit permission to take its picture.The panorama freedom is restricted to taking pictures of the actual objects. Generally, the freedom to modify such pictures is restricted. (a modification for example is to put your companies name on the pic...)
