Ebay Question, by punkwithtats on Apr 6, 2008 20:05:39 GMT 1, I have just won an auction on Ebay for a piece that is going to cost me over 1000 GBP. I have sent the seller a message asking for the provenance prior to sending payment, which as of yet has been left unanswered. At this point (it has been four days since the auction has ended) I not sure what to think. Has anyone else had a situation like this? Am I wrong for requesting provenance prior to making payment?
Please respond with your thoughts.

Ebay Question, by GD303uk on Apr 6, 2008 20:27:33 GMT 1, yeh , you should have asked all questions prior to bidding, but its not out of order to request them now , but if i was the seller and honestly dont have prov i would be a bit pissed that you are asking now, he/she can see the auction being a waste of time if you back out now. what was it you won? if it is legit it would seem churlish not to pay for the item you could have a bargain and sort prov' out yourself.

Ebay Question, by punkwithtats on Apr 6, 2008 20:29:40 GMT 1, The seller said he had provenance prior to the auction ending (from an auction house he purchased the piece from), but now that I've won the auction I want to know exactly what that provenance is prior to making payment.

Ebay Question, by spirit on Apr 6, 2008 20:36:33 GMT 1, I had a silmilar situation recently. ebay auction stated that seller had full prov from laz. I won the auction and I then requested prov to be emailed to me before I made payment - (after all, surely seller cannot be expected to send his prov to anyone who asks before auction ends - would that not make the fakers life a lot easier?). The seller was perfectly happy to oblige and I then made payment.

Ebay Question, by bonesy on Apr 6, 2008 21:03:15 GMT 1, You should have asked for this stuff before the auction ended IMO. By hitting that buy button you are now in a contract with the seller to purchase. Even if you are unhappy with provenance, or something, at this point he still has to pay all ebay fees.

I don't want to make it seem like I am backing out of my side of the contractual agreement. In the auction the seller said he would provide provenance, and now that I've won the auction and requested the provenance the seller is not even responding to my e-mails. Upon winning the auction I was very excited to have won the piece but am now a little concerned because the seller is not communicating with me.

Ebay Question, by goatislander on Apr 8, 2008 2:39:39 GMT 1, If the seller said that he could provide provenance in the auction listing then he/she should be able to provide before you pay. Something is wrong if they are not responding to your request for provenance.

Ebay Question, by wimpy on Apr 8, 2008 7:04:10 GMT 1, Ummm. Buyers have more protection (if you paid by PayPal, that is) as they can have the money pulled from the seller if they never get the prov.
I'd think it'd be smart for the seller to hold it until payment, to be honest.

Ebay Question, by funyoung on Apr 8, 2008 8:44:29 GMT 1, I recently won an auction. Before winning I contacted the seller to ask about provenance and asked specifically if he would mind me checking with POW after winning but before sending money. He agreed and the sale went very smoothly indeed.
Recommend telling seller what you plan before the auction ends in future. Easier for you both.
Seller has just had new caveats added by you at the last minute. If it was me I'd be wondering if it was a stalling tactic and if I'd be better cancelling sale. He has no idea if you are just out to 'steal' provenance. Patience may be all that is required. Good luck either way.

I thought you were in a contract. But then again what can they do if you didn't pay?

Ebay Question, by manchestermike on Apr 8, 2008 9:25:08 GMT 1,
Yes you are:
"Buyers automatically enter into a legally binding contract to purchase the item from the seller if they win the online auction-style listing or use the Buy It Now feature"
Non payment can (but 99.999% of the time isn't) taken further than ebay

You should have asked before you bought or bid the item.
If you decide to not go ahead with paying agree with the seller 1st so they get their fees credited and you wont get a strike

Ebay Question, by punkwithtats on Apr 8, 2008 14:14:36 GMT 1, As of this morning, I decided I would pay for the item using paypal and my AMEX card (the auction said paypal was a preferred payment method). But when I went to process the payment, I get a message saying: "ebay unable to process paypal payments please select other payment method: bank transfer or personal check." I've never seen anything like this prior and I am now much more concerned about this auction than before. I was willing to pay for the item using the protection of paypal and AMEX but am not willing to pay with a bank transfer. Plus, after seven e-mails to the seller I still have yet to recieve one reply.

I'd pay on a different card if I was you, AMEX are a fucking joke and offer zero protection unless they want to

Ebay Question, by rydal on Apr 8, 2008 14:25:05 GMT 1, If you are thinking of the usual protection you get under Section 75 of the Consumer Credit Act, ie that the credit provider will be equally liable for any breach by the supplier, this will not apply where the card is used via paypal.

Ebay Question, by spirit on Apr 8, 2008 15:08:42 GMT 1, I would be a bit concerned if you have sent 7 emails and got none back. I would send another email to the seller telling him about the paypal payment problem and say you want to discuss another payment option with him. That way the ball is in his court until he gets back to you.
