SMALL BIRD TOLD BONGO, by Tyler Durden on Nov 13, 2007 15:52:33 GMT 1, Details requested through ebay. Names matched up. Print order cancelled and monies refunded. That'd be my guess. Or it could just be the person who foolishly put their number up on ebay.

SMALL BIRD TOLD BONGO, by circlemaker on Nov 13, 2007 16:38:34 GMT 1, i know for a fact that pow are planning to hold off sending out any prints for as long as possible to try to trace flippers. refunding peoples money if they a correct identity hit. not too sure how but you would assume ip addresses or print numbers. if i were them they should trace the print numbers and match up to who ever sold it and refuse them a purchase from pow. 1 to pow, 0 to the flip gang

SMALL BIRD TOLD BONGO, by tomdc85 on Nov 13, 2007 17:19:49 GMT 1, Something I've often wondered/ worried about is that LOADS of people have the same IP address as me (well, for some of the year anyway). My uni internet connection means the IPs (I think) will look identical for all but the most thorough checks. Hurm.

SMALL BIRD TOLD BONGO, by klyde on Nov 13, 2007 18:20:23 GMT 1, I'm not so sure. They have the data base so they can track any sold on. Thats more than enough effort.
Obviously if some idiot posts the print number, then that could possibly be canceled (with a little more detective work) but without it, what do they have?
A user name, email, and location of the print, all of which is probably different to anything POW have.
I would hate to think that they are delaying posting these prints because a handful are being sold on. Hardly very fair for the masses is it?

I think once you have bid on an item, you can request sellers details which has full name and Phone number. I'm fairly certain.

SMALL BIRD TOLD BONGO, by worlddomination on Nov 13, 2007 18:53:54 GMT 1, i can't see how they can legally do it at all. There is no contract signed between seller and purchaser agreeing to such terms. Any purchaser who has his print taken away due to flipping would have a firm case in law I am sure under the offer and acceptance laws. I didn't get a trolleys myself so am not trying to speak from a biased point of view. Where's the forum member who's a legal boffin to clarify?

SMALL BIRD TOLD BONGO, by marshman on Nov 13, 2007 19:04:22 GMT 1, i think the law is against selling what you do not own, ie you paid for it so you own it even though you do not have it in your hands (futures etc fall into this category I guess)
the buyers on ebay know this, but it is against ebay policy so each auction could be shut by ebay of they were told........

SMALL BIRD TOLD BONGO, by Young Squire on Nov 13, 2007 19:11:25 GMT 1, I can confirm POW are tracking Trolley prints and have experienced how inept their system for tracking print sales is first hand.
I purchased an unsigned B&W Trolleys print only to have my money refunded back to me a few days later. POW stated the reason for this was that my print had been seen on ebay.
POW did not try and contact me before refunding me my money. Had they done so they would have realised that I was not selling my print nor was there any way I was ever going to do so.
I applaud POW's efforts to stop the flippers, but am seriously chuffed of that some idiot flipper has quoted my print number on ebay and caused me to lose my print. I just hope another forum member was lucky enough to get it or it's probably on ebay already!

This does not sound true. If it is, there is no way I would accept it thats for sure.

SMALL BIRD TOLD BONGO, by Young Squire on Nov 13, 2007 19:28:29 GMT 1, It is true, I have been emailing Dora for the past week, in fact I am fairly sure they have had enough of me complaining about it!
This is what they had to say:
It seems that the print you ordered from us was seen listed for sale on eBay and therefore the order was cancelled and refunded.
We work hard to make the releases of these big sellers as fair as possible, to ensure that genuine buyers/collectors get a chance and to prevent the immediate re-sale of the prints for profit ...
Kind regards
Dora

To quote POW's T&C...
"Picturesonwalls reserve the right to issue refunds at any time prior to delivery."
These are the terms and conditions you agree to when making the purchase, so they have possibly several legs to stand on and they can refund for any reason whatsoever including suspected flipping.

They can say what they want in T&C but it could be legally meaningless if they breach distance selling regulations etc. I was just under the inmpression once they had taken money from your account they had to deliver the goods unless there is a reason out of their control that stopped them from doing so...
I am not 100% sure though, it would be interesting for a lawyer to shed light on this

Exactly. That's why I think they may be acting as if they are above the law.
And besides, was it not them that told us to get our eBay accounts on standby?
Not that I'm a flipper! But I don't have a problem with those that do (look how cheap Trolleys are going for now the market is flooded).
