Carmichael Gallery Problem, by instinct on Oct 18, 2011 20:49:45 GMT 1, findtom has every right to state the facts of his case. If I was out $5500 I would be very f*****g mad! If the person who had my money was ignoring me, I too would use all means at my disposal to get MY money back. I would also feel not one ounce of concern for the person who knowingly had my money and who was failing to even show me the common decency of replying to my mails.
I wish you all the best in your efforts to get YOUR $5500 back findtom!

Carmichael Gallery Problem, by nrgball on Oct 19, 2011 3:37:42 GMT 1, When you send a business your cash, you make a contract. You agree to pay them and they provide a good or a service. This gallery welched on its end of bargain and then ignored many responses. It only reopened communication after its reputation was threatened. Bad business, period.
I tend to think the findtom negotiated a really good deal. So good, the business realized they needed to back out. Again Bad business.

Carmichael Gallery Problem, by misterx on Oct 19, 2011 4:06:16 GMT 1, Seems to me that asking the advice of total strangers nowadays seems more of an option than going through the proper advice channels... Oh well, whatever floats your boat man, personally I keep my business to myself.
whats Tom's proper advice channel? he phoned repeatedly etc etc. He spent two months using orthodox channels...IT GOT HIM NOWHERE!! NO REPLY. Where does one look to find "this channel"? I, for one, can only think of the LAPD, and clearly Tom chose to go public rather than go to the cops. I think the Gallery got off lightly, having essentially stole tom's money. Cant believe people would come on to this thread and put down the victim here....seems your sticking up more for the bad guy than the aggrieved party! If Seth had any sincerity he would have contacted Tom. The fact that he seemingly ducked and dived speaks volumes for his intentions.
Note to self: Carmichael Gallery = no thank you.

Carmichael Gallery Problem, by Jeezuz Jones Snr on Oct 19, 2011 8:04:31 GMT 1, Totally agree with misterx and Jonny posts.. if he didn't go public Seth would have strung him along further. Now he's got a bit of karma coming his way ie. His wife could run off with a guy with a huge cock! Or he will realise there's a big art community out there and people will learn about this/think twice and rightly so may shop elsewhere. That's business....

Carmichael Gallery Problem, by johnnyh on Oct 19, 2011 8:29:47 GMT 1, There are of course lots of ways of dealing with things and variations. However think it is worth considering that if you had handed over 5000 grand for a painting and two months later you had no painting one would feel slightly disapointed!!!!
I for one am glad to hear of this experience as I often due to being in hong kong often have to buy at a distance. So feedback on galleries etc whether good or bad is very useful.
This for me is one of the points of the forum people discuss art, galleries, experiences and opinions.
I had and will mention their name a really bad experience with Cadogan Tate the art shippers. Which was only solved with the threat of legal action. It was also over a serious chunk of change. So whether the threat is legal or publicity no great difference I will also write up my story with them when I get the chance as their treatment and lies was an absolute disgrace and I would not wish that to happen to another member of the forum.
Thx johnny

Carmichael Gallery Problem, by tobaum on Oct 19, 2011 9:09:47 GMT 1, It is indeed very useful to have feedbacks about galleries, etc, especialy as I also often buy at distance. But my concern here is that we have only one side of the story, anybody can tell anything about a gallery and once it is public, the bad reputation is done weither the story is true or false or almost true. Not saying findtom is liying, just that this is a bad habit. + Seth Carmichael don't use this forum for his publicity (can't remember the last post of Carmichael gallery on here) so it is not even sure he is aware of this thread. He should at least have the right to react.

I'm sure he knows of this thread and that's why he suddenly 'out of the blue' contacted findtom.
Somebody from the Carmichael Gallery logged into their account yesterday!
And if they have time to go on social networking sites (no problems posting on their facebook page in the last few days), it does make you wonder why they haven't replied to this thread?!
Anyway..I hope you get your money back Tom.
If there is one thing I cannot stand, it's poor service, especially when you have laid down a huge chunk of cash in good faith.

Carmichael Gallery Problem, by Cedric Mnich on Oct 19, 2011 9:58:08 GMT 1, This is a good lesson to be learnt by galleries. In the era of Internet / social networks and forums, information runs fast. It is not the first time we read such a subject here and people should be informed when buyers face problems getting the art they paid for. A reputation can be ruined in a few minutes if one does not face his responsibilities and ignoring mails or phone calls is not the solution... Carmichael Gallery should clear the situation asap imho. It is sad that a buyer has to make public the problem but 2 months is a long time when you get zero feedback and you have 5 grand at a stake. Now it is made public, people may wonder about the honesty of the gallery (which seems a good one by the general feedback here so maybe a temp problem ?), its financial health (does it have cash problems and on the point to closing doors ?) or its commercial practices (did it sell to another buyer at a more expensive price ?). Good luck Findtom on that issue but I guess things may go faster now things are going public and it could help your issue to get solved. Having 2 pages on UAA on that issue is not good publicity at all and if it reaches other places such as social networks where many artists and collectors are collected it could ruin the gallery business, which would be good for absolutely no one ! It would be good the gallery, if a member, gives its version for a good comprehension of the situation and clear it out with no one harmed in the end...

Carmichael Gallery Problem, by nah on Oct 19, 2011 11:47:13 GMT 1, I find threads like these are actually counterproductive - I know of someone else who is owed money by seth, and for longer than 2 months, but he is working with seth to get his money back, and in doing so, isnt airing his private business out there for others to speculate on it. You have other means at your disposal in order to get your money - as you said, you have filed a moneyback request with Google Checkout, and you have also contacted the plod in LA - so why not exhaust those avenues first before going public?
sounds like it may be a common issue then do you not think collectors should be warned if that is the case?

Carmichael Gallery Problem, by krevice on Oct 20, 2011 3:38:34 GMT 1, funny that no one has mentioned the nick walker that was recently sold at auction for $4000+ The seller being Carmichael Gallery It doesn't help the purpose of this thread starting rumours, unless you know for sure? Just because it had a Carmichael COA does not mean they submitted the work, maybe just that the piece was purchased from Carmichael gallery at some point.
Rumors haha
that og was on their website for years at some crazy high amount
that og would not have sold at that stupid low price unless someone needed the dough quickly

Carmichael Gallery Problem, by pezlow on Oct 20, 2011 8:26:44 GMT 1, Threads like this are sad for everyone involved. Its sad when a collector feels that as a last resort he has to post something up. And it is sad that a gallery which has built up a lot of goodwill over a number of years it appears is struggling to pay off at least 2 creditors (from JV's post).
But this is a community where people should share positive and negative experiences. I don't have an issue with the OP going public and I would have done the same thing if my cash had been lost. Very few of us can afford to lose 5 grand.

Carmichael Gallery Problem, by matbat on Oct 20, 2011 8:45:55 GMT 1, Im glad this has been resolved tom and you have received a full refund. As an art buyer i will in the future be cautious of buying through seth and his gallery. It seems that this posting has helped and we should all learn something from it.

Did Findtom get a refund from Carmichael or from Google Checkout?
I suspect its the latter

Carmichael Gallery Problem, by lifeonwalls on Oct 20, 2011 18:11:27 GMT 1, From the looks of it airing these matters in a public forum may be the best approach after all.
So I wonder what their higher offer was for the piece?
Sorry to hear about your dilemma OP, and glad you have been refunded. He should pay you interest on that $5k.
