It does seem that the criminal justice system seeks to punish damage to property more severely that damage to the person. I liked the point made about "destruction" above. Some of the comments from the Daily Hate readers just stagger me. In reality, the guy knew he was committing criminal damage. He knew the consequences of being caught. But can't have expected such a harsh sentence. Obviously I hvent read the full summing up, and appreciate that the judges commenst may have been taken out of context, but it seems a very unusual comment from the judge about Banksy. Is he suggesting writing on the streets is acceptable if what you write is witty? Who decides that - the judges?! Or is he suggesting writing on the streets is ok, but only if you are Banksy?! Seems unjustifiable imo.

From personal experience I know there are usually countless cautions and smaller penalties before it comes to this. Even still I think the judges comments and sentencing is harsh. Example?
