Writing a book about Banksy (copyright question), by Emile on Jan 17, 2014 17:12:04 GMT 1, Dear all,
I have began to write a text on a particular part of Banksy's works through a somewhat academic scope. I expect it to be around 70 pages, quite a few of which would be pictures of the works. I am not quite sure whether I want to actually publish a book out of it (commercially, either hard-copy or ebook format) or simply "publish" it online for free (give it away in PDF format).
Can anybody shed some light on how Banksy deals with copyright?
- I do not have any pictures of the works myself. Rather, I would want to use Banksy's own published images. Who would I contact about this? I imagine there are a few people on this forum who have published a work surrounding Banksy's art. What approach did you guys take?
- Similarly, what about pictures taken by other people of the street works? Would it be sufficient to simply have permission of the original photographer?
I'm sure there is some fair-use in all of this. I have academically published on film before and you can use screenshots of films without copyright issues (albeit probably for non-commercial purposes only).
Would love it if anyone could help me further with these questions and/or give me some pointers on where to ask these questions.
Best, Emile

Best, Emile It's always correct and the best policy to ask permission to use published images.
As far as I know. Anything that is out in a public place including graffiti and art painted on outside walls cannot be copyrighted.
I could well be wrong but if a picture is painted on the side of a house or a wall and someone photographs it, because it's in a public place, the photographer can do what they want with their photo.

Writing a book about Banksy (copyright question), by Emile on Jan 17, 2014 17:37:29 GMT 1, Thank you for your answer!
That would make it a question of who took the pictures I would like to use (opposed to who made the artwork).
So I guess I would have to contact Pest Control then?
Emile

And once you've asked that initial question you've opened a can of worms and can't then claim ignorance.
Just do it, and apologise if anyone picks you up on it.
I did it with a film and gave up trying to secure rights because of what everyone was claiming I had to do. I just released the film and sure enough, no one f'in' cares!

Writing a book about Banksy (copyright question), by Emile on Jan 18, 2014 12:11:24 GMT 1, Thanks for the feedback everyone
That's definitely one way to do it... Considering it
Anyone know anyone who has published a book on Banksy? I seem to remember a topic on this forum by someone who had written a Banksy locations book, which I believe is still available through websites like Amazon.
I'll try to look up what/who it was.
