Shipping Logistics Question Re: Insurance/Damage, by sufsean on Mar 23, 2017 19:37:25 GMT 1, Here's the example:
Seller ships to buyer via carrier, insured.
Package delivered to buyer damaged (in this case, artwork).
Does seller or buyer file a claim, and if approved, who gets the insurance money?
Secondary question: If buyer pays through credit card--what are logistics of going through credit card company?
Insight much appreciated

Shipping Logistics Question Re: Insurance/Damage, by kbfrombk on Mar 23, 2017 19:47:24 GMT 1, with these details i would think seller is bound to refund the buyer and take up the claim with his shipper.
the insurance company will probably ask what the outcome was; if the buyer elects to keep the print then they'll negotiate an amount of damage or go along the terms of the policy.
record everything that happens, in writing, to keep everyone insulated.

Shipping Logistics Question Re: Insurance/Damage, by Matt on Mar 23, 2017 19:57:43 GMT 1, If this was not art, the seller would file the claim assuming he booked the shipping. It would help a lot if the declared value was in line the claimed amount, and if the buyer refused the package.
This being artwork, the shipper is likely to waive any compsensation, at least at first (unless their T&Cs do not exclude art, which is rare), so it is going to be a battle.
Which is why I would suggest at the same time for the buyer to get to in touch with the CC company and see what he can be offered
All of this under the assumption that buyer and seller are working together towards resolution...
Good luck

Shipping Logistics Question Re: Insurance/Damage, by Deleted on Mar 23, 2017 19:59:38 GMT 1, It's very straightforward. If the insurance is with the courier, as it should be, then it's down to the person paying them.

Good luck in the event in which a CC would take care of it for buyer (probably not likely, but if)--would an insurance claim w/ carrier still be done?

The courier, that's pretty understandable in my post..them wouldn't refer to the seller would it?

Shipping Logistics Question Re: Insurance/Damage, by sufsean on Mar 23, 2017 20:58:43 GMT 1, So in this hypothetical--let's say Buyer purchased a Banksy Print for say 5k and it came damaged.
Seller had mailing insured for 5k. Should buyer expect to get full refund and keep damaged print? ...
Trying to gauge what's the overall buying/selling dynamic on here in terms of receiving damaged print--and what's the overall first instinct should the buyer have?

No you would have to return the print, the insurance is the sellers and he would need proof. Also if you've been refunded you haven't bought it so why would you keep it?

Shipping Logistics Question Re: Insurance/Damage, by kbfrombk on Mar 23, 2017 21:18:18 GMT 1, if you bought it, you should try negotiating a discount from originally agreed price with the seller. they can then approach their insurance with that conversation in tow, and use it to recoop the remainder of their loss.
it really depends how flexible you are with it being damaged......

Shipping Logistics Question Re: Insurance/Damage, by I Woke in Relief on Mar 23, 2017 21:20:22 GMT 1, Seller had mailing insured for 5k. Should buyer expect to get full refund and keep damaged print? ... Agreed with what others have said - but I'll also add, and this 100% depends on the extent of the damage, but it's likely that the insurance is not going to pay out the full cost of the print, unless the print is just completely destroyed. They're probably going to make the seller get a restoration quote, and play hardball from there.
So, if refunding the buyer, the seller should expect the print to be returned, as the seller is not going to be made whole through the insurance, and is only theoretically whole through whatever they get from the insurance + the returned print.

You pay the 5k. Who would keep a damaged print? Get your money back and find another. I think we are now overthinking this!

And if you happen to locate another one 5 days later, its probably already appreciated 10%.

Shipping Logistics Question Re: Insurance/Damage, by sufsean on Mar 23, 2017 21:50:40 GMT 1, if you bought it, you should try negotiating a discount from originally agreed price with the seller. they can then approach their insurance with that conversation in tow, and use it to recoop the remainder of their loss. it really depends how flexible you are with it being damaged...... The answer is--flexible.
In this example, buyer wants to keep as the print is extremely hard to get and can't be replaced. However, they want to be compensated in some way for the damage, but also keeping the whole ordeal on agreeable terms between buyer and seller.

Shipping Logistics Question Re: Insurance/Damage, by Happy Shopper on Mar 23, 2017 23:54:37 GMT 1, The seller is just going to have to make a claim and keep the buyer informed. Whatever compensation the insurance company agrees to will be what the buyer gets, ultimately. The buyer will just have to be very patient, or send the print back for a full refund, and the seller will have to make their claim anyway.
I think that covers it
