It's no different than Banksy borrowing from Warhol. Art evolves and plagiarism is the norm in art and always has been.

the Shepard Fairey piece is based on a one-off he did for a charity auction.
Many artists were given pages from an old 50's paint-by-number and told to go nuts customizing them as they see fit....

If Shepard is guilty of anything there it is simply using a theme everyone is using these days - grenades. But, it could have been much worse, he could have used angels, skulls, and corporate logos.
Hell, at least he got his Che out of the way in 1997 and his Marilyn in 1995 and another in 2000.
