I've not seen him previously, due to lack of interest, but if he is the guy on right his trousers are too long, need tailoring, and the overall outfit not very flattering. Just my opinion.

This is exactly why it would be considered misrepresentation of the artist/fair use and illegal. Just because you bought an artwork doesn't mean you can do with it what you please. You can't buy a piece and than sell it for use, or tour it through live nation. All of this still requires permissions. He is part of this 100%. Live Nation wouldn't touch this if he wasn't.

That is a completely different situation. Banksy willingly put those pieces in the public domain, on property that didn’t belong to him, meant to be freely enjoyed by the public. There are a lot of conflicting legal issues with any ownership rights banksy may claim to have there.
That isn’t the same as privately selling an original work of art, of which he still owns the rights to the image, reproduction, and exhibition for profit. The legal rights with that are pretty cut and dry. And copyright protections for original works of fine art are generally even more stringent than those for films, albums, and music in general
