Seems likely a lazy designer/ad agency thet Coke have employed used it with a Photoshop filter thinking it was a random spray and not from an artist... hell theres a likelyhood the designer/ad agency aren't even lazy and bought a royalty free photo from someone like getty images and used that as the starting point - not sure how the law operates in this scenario, if an artist has put it on a wall they don't own and it's photographed

As previously mentioned here, I believe Fairey's position had been very strong. The HOPE image was in my view sufficiently transformative so as to not constitute improper appropriation of the AP source photo.
Regrettably, Fairey shot himself in the foot when he chose to destroy documents and manufacture false evidence. Once the truth came out, he was left with no leverage in his settlement negotiations with the AP.

If you have a look on Google images "pulling back curtain" there's some that have the same concept but the execution is different.

That sort of borrowing looks totally fine to me, and in line with the last many thousand years of art (in all of its forms). Art feeds on itself, and thatโs normal. In a sense, all art is derivative. Most of the visual ideas that made Caravaggio a master were actually borrowed... But a weakness arises when the derivative product is less interesting than what it derives from. I.e., the problem is that MW ainโt a Caravaggio ๐
