The artists never assigned or licensed the use of the art, so they retain ownership of copyright"

Okay. I'm a street artist and I paint on the street so all can see BUT how dare you take a photo. Actually I've changed my mind I want to paint on the street but restrict who can view it now! Okay street artist great logic.

The big distinctions to make here are that: (a) an artist can place his art wherever he pleases, doesn't mean corporations should be allowed to steal his work / copyright for commercial purposes and (b) the unauthorized uses / transformation of an artist's recognizable work (especially for commercial purposes) damages an artist's work value and reputation. So there is a big distinction between posting photos of an artists' work and using / transforming it wihout authorization for commercial purposes

So yeah they could have a claim. Also, same thing with people who publish books/calendars with street art photos, they need the artist's authorization to do so (which they usually do)

the company has now ceased trading after paying the donation but still receiving a lot of nasty emails about it as for the band, well who cares, they sound rubbish anyway
