But to fine him double the painting's value and confiscate the painting is stealing in its own right. It would be fair if they? bought back the painting at a discount of what he paid for it.

Like how are people unable to smuggle things out on luxury yachts? Seems like an easy way to smuggle things and people out of one place into another.
Does anyone know what kind of protocols are in place to prevent this. There is so much waterway when and where are boats and cargo checked?
Also, very stiff penalties for trying to smuggle the Picasso out. Crazy!

He was probably grassed up. The people at that price level in the art game hide a lot of information from the public but do talk among themselves about all the dodgy stuff going on. It could be as simple as the boat captain or crew did not want to be tangled up in art smuggling for a tight arse billionaire or that the owner was not discreet when planning to get the painting out of the country and the authorities tipped off. it could even have been a very wealthy rival who tipped off the authorities. Looks like the owner did not trust the painting to be taken out of the country by a third party so decided to do it himself on his boat.
Discretion is everything and it is not hard to get something like this painting out of the country and even if he succeeded. How will the new owner be able to display it as there would be a seizure order on the painting by countries. If it was to be sold in Switzerland it could have ended up in a Swiss vault or any other country where people with money like that type of art.
