Nanzuka Gallery Info Needed , by sfnyc on Jun 19, 2020 19:11:24 GMT 1, I gave up with ever trying to deal with Nanzuka as well... they're overpriced, sell to friends / fam first, and barely ever reply to emails.
Good luck!

Most don’t respond and the ones that have are outrageously expensive I had a piece shipped from Kyoto and the crate has 'Terrada Art Assist' stamped on it, which seems to resolve to www.terrada-art-assist.co.jp/ - the crate was pretty standard and perfectly adequate. I didn't arrange the shipping so don't have a contact to offer, although unfortunately the shipping itself wasn't cheap.

How enforceable do you think such clauses are?

I know some - not all - auction houses won’t touch the item if they have clauses on them still.

Nanzuka Gallery Info Needed , by LJCal on Jun 20, 2020 3:30:32 GMT 1, You down with the restrictive 5-year non-resale agreements for Javier Calleja right? If you know, you know. How enforceable do you think such clauses are? In practical terms they are unenforceable especially if the gallery is in a separate legal jurisdiction. The cost and complexity of issuing proceedings outside of your country makes it highly unlikely that pursuing such a claim would stack up commercially. Even if a gallery pursued someone in their own country, I’m not convinced they would succeed, as there is a strong argument (in English law) that such clauses cause an imbalance of the parties rights under the contact to the detriment of the consumer and therefore may not be enforceable. Usually a gallery would not go down the route of making a claim in these cases but would black list the collector and probably run their name through the mud with other galleries. I’m not advising anyone to breach these clauses without taking legal advice as it will depend on the wording of the clause and the circumstances of the individual case.

I know some - not all - auction houses won’t touch the item if they have clauses on them still. I’ve yet to meet an auction house who cares, perhaps on higher value works where they have a relationship with the gallery but I highly doubt they would turn down editions or works from emerging artists from small galleries.

Really thats not what agents at heritage and Philips will tell you. They will look at it but unless the clause is over they’d rather not touch it. I know heritage had issues before so they rather not take them anymore is what I’ve been told by heritage. I just had a conversation about this issue with heritage two weeks ago and that is what they told me.

I know heritage had issues before so they rather not take them anymore is what I’ve been told by heritage. Possibly I’ve never consigned with either but a couple of well known houses (won’t name them) have been interested to consign a work of mine that has a no resale clause (I didn’t agree as it’s a favourite and want to stay in gallery’s good books). As I said I think it will depend on the work, gallery and auction house. Legally the gallery have little recourse against the auction house as they were not party to the contract containing the clause, a gallery may be able to get an injunction to stop the sale but this is highly unlikely.

What I was told was a gallery recently tried legal action against heritage and caused a big stink. Ever since then they don’t want to sell them. Again not all auction houses but some are thinking twice about them now.

Nanzuka Gallery Info Needed , by Express Post on Jun 20, 2020 4:30:46 GMT 1, I'm curious how at least a couple of auction houses knew you had a certain piece unless you ran it by them. It can't be a coincidence.
