Thanks Well, if an auction house is crooked enough to sell a fake they wouldn't be bothered to grab that extra 4% for themselves as well, I guess......

It simply means that the auction house pays an amount if the hammer price is over 1K (euros). Incidentally, does anyone know if the auction house actually pays the artist directly? I doubt it somehow. Surely every auction house doesn't have the bank details of every artist they happen to sell in one of their lots. I think it's similar to the Performing Rights Society - collected centrally, then distributed (minus a fee, naturally). www.gov.uk/guidance/artists-resale-right

So I'm guessing that the organisation concerned wouldn't have a clue if the ARR is from a genuine painting/print or a fake one. Correct - if the auctioneer says it's a Basquiat, and it sells for over the ARR limit, as long as they send off the correct amount of money then the ARR people are happy, the estate of J-MB are happy, and the buyer is none the wiser. I don't know if artists are given breakdowns of exactly what sold and where - I'm assuming not, but if they were then I guess they may be able to flag up a fake sale. Highly unlikely, though.
