This summer I enquired about a few of his pieces and I expressed interest in two of them. Of course I asked for a discount. He moved a bit from 6500 to 6000. I used Transferwise to send the money to him. I asked him for insurance and to make sure the package was secure. He said that to get insurance via UPS would incur duty and that he has done this so many times without anything ever happening. I didn’t have time to purchase insurance through a third party because i didn’t have details of the shipment. Despite this, there was great communication throughout with tons of pictures of every step along the way. The package arrives the next day and the piece is broken. I call him up via video chat and show him the broken piece. He tells me that I have to file a claim with UPS, which I do. UPS tells me that they will contact the shipper based on the information at hand. 6 weeks pass and I reach out to him. He casually brushes it off as “they said it was your fault for not opening the package in front of the driver.” (I live in a high rise in New York City where that is just not what you do.) No insurance, total loss.
So I said, let’s come to a compromise. We will go 50/50 on the piece. He says what if I give you a discount on another piece. OK, I say, I’m open to that. Great, he says, I will find an art shipper and will revert. A month goes by and because there is a pandemic I realize that I might not stay in the city. I let him know this and he freaks out, accusing me of breaking the piece purposefully because why else would I ask for insurance. He says that I owe him for transporting the piece to Paris (I’m confused as to why?) to get shipping quotes. I try to calm him down, and say, just communicate with me. You were great before but now you have my money so if something takes a long time just tell me. (Also when I told him that reputations take a lifetime to build and seconds to destroy, he said he didn’t care because he doesn’t do anything in art, so go ahead, tell everyone!)
Months go by and finally we say let’s do the deal. I say OK, let’s use Escrow.com and I will pay 100% of the fees. This is where he loses it again and says that these services (PayPal was also mentioned) protect the buyer. He said the piece is fully insured so why would I care? He said if I insist on using Escrow.com the deal is off. And so like that I’m out 6400. (He’s gone cold silent for 2.5 weeks now)
In the end, I have learned my lesson. I should have known when I Googled “(Name removed)o” the only things that come up is that he is opening a sneaker store somewhere outside of Paris (Seichamps) and that he is into cougars (older women). That’s it. Should have been a red flag. Anyway I am not going to get that money back, it sucks and as someone said, when i look at that art (which is broken anyway) this entire nasty transaction will be in the back of my mind.
Hope 2021 is not like 2020….

To be honest, I really don’t appreciate your behaviour and your threats.
We agreed for a global deal with 2 sculptures, I have reduced the price for the first one cause you should buy the second one.
You received the package in perfect condition , no blows on the package, corners in perfect condition
You told me that the sculpture arrive broken, we can imagine a lot of scenarios :
1) Maybe it arrived broken but it’s quite strange because package was in perfect condition, AND you are not able to find all elements of the sculpture, ceramic can’t be desintegrated it’s not plaster. All the sculpture was inside a wooden box so it’s quite easy to take a look.
2) Maybe you already have a sculpture broken and you tried to rip off me .
3) Etc . . .
You can take all insurances of the world, if you don’t open the package at the moment of the delivery, you can’t ask any refund and I think you know it. It’s for this reason that actually I don’t receive refund of the insurance because you open after the delivery. Maybe you received them in perfect condition and the sculpture is fallen in your apartment, nobody knows except you. . .
You have insisted several times for an insurance, it’s quite suspicious for me as I have never had problems during the shipping for many shipments and you know that classic companies won’t insure art items. You told me that you have had problems in the past but you didn’t opened with the delivery man ??
To be honest I was waiting your behaviour for the rest of the deal to make me an idea about really happened with the first shipment.
You offered me a half refund for the first deal, I have accepted your offer and I asked you if I can keep it as an advance for the second one, you have ACCEPTED the principle so it suppose we finalize the deal.
It’s a quite good gesture (3000€ discount) from me as I have no proof it’s my sculpture you sent me pictures and I have received no refund from the insurance.
And now you find pretexts for don’t respect your word and stopping the deal, I will move of my apartment, understand the situation 🤔, it takes too long for having the quotes 🤔, for sure your pretexts don’t seems to be serious.

Don't give up checking the tracking though. I received a parcel the other day(not high value) that I had refunded 3 months ago as it never turned up. Post date stamp on parcel was September when it was originally sent.

It's when things go bad that you can tell someone's integrity. But for your lesson even with proper insurance you can get fcked... Same situation happened to me as well (I was the seller). Fedex destroyed the artwork and decided because it contained glass that they would only refund up to 1k...Apparently if there is any form of glass in the package, it limits their liability to 1k even if you buy more insurance. This was less than 1/3rd of the artworks sale price. I bit the bullet and fully refunded the buyer against being sent back the damaged work without fuss. One thing I am wondering in the US is if one can still sue the shipping company for destroying a recognizable work of art protected by the VARA Act?
