What to do when...., by Balboa on May 7, 2021 18:52:54 GMT 1, I sold a Grin Reaper and a signed J&J around 2008 for less than £2K each. I emailed Banksy to tell him I had sold them and asked if he wanted any money because I had made a profit from his work. He replied, asking me to make a donation to a charity that helps the visually impaired. I sponsored a guide dog through their twelve months of training. If that's true hats off to you mate.

I actually think I remember this from 2008 and feeling equally as impressed at the time.

This is such a shit thing that happened to me today and I know there’s nothing I can do about it, but, just curious if anyone has dealt with this before and wants to commiserate with me. I wish I never sold this painting to this person. It makes me regret the whole damn sale and I would rather have it hanging on my wall then the money. Ugh. Had anyone ever dealt with this before?
I don't really understand. Did you pay for the painting? Was it yours to do with what you pleased? Ownership is just that... ownership. If you owned it, and you sold it, then it doesn't really matter what the artist says. If the artist gave you a gift, 3 weeks ago, and you turned around and sold it...well it still doesn't matter as far as ownership goes, but the artist might have a right to be angry about that.
Was the buyer a complete tool for agreeing to something, and then doing the exact opposite? All so he could have his cake and eat it too? Yes, total jerk.

It is about joy, passion, love, beauty, but also about supporting the weak and giving those who cannot be heard a voice. Art can be a powerful force, to uncover social/political conflicts...(There are so many more things to say). Lucky are those, who have the chance to enjoy art! Of course, there is the other side of art, being considered as a business. And to some extend it certainly is. But without the things, mentioned before, it would be nothing!

I would assume it could get back to the artist or gallery and I would assume they would be upset, not give or sell to me again, etc.
As for the buyer there isn't much you can do. You can never sell to him or her again. If you want to be nasty you can call them out publicly.
But in the end any time someone breaks a resale agreement or sells something they want to remain private they are taking a chance. One must decide is the money worth it...
Ive' had at least one seller who had gotten gifts from an Artist call the Artist to let him know he had fallen on tough times and the Artist was ok with him making some sales....

1. Artists give friends, galleries, promoters, etc pieces all the time. Often these are given as birthday or year end gifts. It rubs the artist the wrong way to give away a 5 or 10k piece and have it flipped.
2. An artist or gallery gets you a piece cause you kissed up and got up in their butthole. You then flipped the piece and the new buyer wants to replace you in said butthole.
These are the two situations and they happen all the time.
I probably have 50 pieces with verbal resale / no posting for 6-12-24 month agreements. I honor them but many people do not. Along side these agreements though is always a reduced price unless the piece is so one of a kind that you can't negotiate. I have at least a dozen pieces that were birthday gifts and if I posted them I would wreck some gallery relationships so obviously I do not.

According to the suit, Michael Xufu Huang, a prominent Chinese art collector and socialite, had a financial agreement with Monaco-based Argentinian collector Federico Castro Debernardi.
The nature of the deal was that Debernardi would use Huang to buy difficult-to-secure artworks. Huang would purchase the pieces in his own name, then quietly resell them to Debernardi for a 10% commission.

It doesn’t sound like you brought the piece to flip originally and have actually enjoyed the piece- so I wouldn’t worry about it.

What to do when...., by esfer on Jan 17, 2022 14:15:09 GMT 1, I really doubt there is any situation where an artist is going to demean themselves to accost a collector that has resold a piece of art to another collector, unless it was a gift, or you begged them for a piece, or a steep discount swearing you would never sell on your mother's life... then flipped it within 6 months of purchase.
Even then.. difficult to imagine many artists really caring enough to get directly involved.
It's a possession issue...as an artist, I simply wouldn't sell to them again at a discount or care what place they were in the queue going forward.
Artists have to be pretty high on the popularity scale to even have much of a resale market to begin with, and artists that do are often having works resold... those that are that popular better adapt or go crazy caring about who has what.
Even having a "no resale agreement" at all, is really dumb in my opinion, baring certain circumstances. Those circumstances being that your works are flipping all the time constantly for big money, at major auction houses.
Artists should be so lucky to have these problems.

They’ll still be nice to you but every request will be met with “every piece has been placed”. And you’ll ook him/her in the eye and you’ll see that little glimmer in the eye that says “I know, that you know, you sold that piece I let you buy….fuck off”. So then you start sniffing around Almine Rech instead.
