I think most galleries understand these clauses are probably not worth the paper they are written on and practically find other ways of dealing with these breaches aside from enforcement. This is probably why their is no case law relating to these clauses and the reason galleries tend to go down the route of blacklisting and naming and shaming as opposed to through the courts.
