Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 14:32:05 GMT 1, Bought on thursday, money was refunded without an email saying why, still haven't heard anything either way. Have emailed a few times and was eventually told they were trying to resolve it and i'd hear from them again soon, but no mention of me being reallocated, or losing it in the first place. My print number was 241, i still have the confirmation screen open on my work computer!
I agree totally, if you bought it on friday its not your fault is it??? both days should get comp. We'll see what they say, i'm sure they'll sort it all out for everyone..... (fingers crossed)...

Banksy NOLA Print on POW, by liveforever on Nov 27, 2008 14:32:13 GMT 1, Would you accept a promise on the next print? What if you don't like it, the edition is too high or it's very expensive? Personally I wouldn't accept it without those details which are sensitive and may not actually have been decided on yet.

Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 14:34:04 GMT 1, I would accept the opportunity to buy it as compensation for not getting this one. Not to say i would buy it, but to be given the option would be nice. I have to say i really like the NOLA print, so keeping my fingers crossed i still somehow get mine....

Banksy NOLA Print on POW, by chrisj on Nov 27, 2008 14:36:01 GMT 1, Schlomo, same boat, mine was 243. I've got to say the edition should have sold out on Thursday so there should not have been a sale on Friday but I also think it's hard on the Friday people to get nothing. The next one might be better than Nola though.

i understand where your coming from, but there only 289 prints. so some may have no option to accept a future print offer.

Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 14:41:20 GMT 1, It'd be interesting to know exactly how many people this happend to, that way they could print the next one to match that number and offer it first to all those who got refunded this time round. Don't think its gonna happen tho!
My fingers are still crossed for myself and everyone who has had this trouble.

Banksy NOLA Print on POW, by redfred on Nov 27, 2008 14:42:12 GMT 1, I still think POW will be trying to sort this out, its like any problem of this nature you deal first with the easy ones then you are left with a small hardcore which you then have to make some difficult decisions about, but fingers crossed that they will come across!

POW offering up another print is a courtesy, not a right. If you choose not to accept it that's up to you but it doesnt mean you have the right to demand anything else.
I dont get it, POW is truly going over and above to try and make people happy. It's not their fault people simultaneously added print number XXX to his or her basket. They are doing their best to make people happy and offering people first dibs on the next go round is far better than just having your order canceled.

i agree, it's nice to at least have a chance for us to decide we want it or not, if we liked it, we could save some time F5ing, if we didnt like it, wait for another one and F5ing again
but we still dont know that future print promised is true or not since many of us still haven't heard a word from them directly......

I'm not a lawyer but a lawyer told me that it is very much your legal right to demand it. I'm sure it will all be sorted out and in a few weeks we'll all laugh about it but a bit more communication would be nice

IMO they're talking about specific performance but if POW don't have the print to give then you can't make them create one for you. It was a limited run.
Your only recourse is compensation and I think POW have offered that by way of a guarantee on the next run. If you don't like the offer, go ahead and litigate.
Personnally, I think you'd be wasting both time and money but maybe you have a lot of both. If that is the case then go nuts with it!!!

Banksy NOLA Print on POW, by liveforever on Nov 27, 2008 15:05:54 GMT 1, I'm not a lawyer but a lawyer told me that it is very much your legal right to demand it. I'm sure it will all be sorted out and in a few weeks we'll all laugh about it but a bit more communication would be nice Did your lawyer read the POW Terms of service? Quite simply pow can cancel any order at any time and they dont have to give you anything. www.picturesonwalls.com/Terms.aspI suppose legally it is within your rights to demand it, but legally POW doesnt have to give you anything. Honestly, I havent seen anything like this. Last year I waited online for a wii, if I had gotten to the front of the line and they had sold out well, then that's that. Even if they had rang me up totalled me out and then said, oh crap, in the time we were ringing up your order it sold out, I am sorry, we will have to refund your money then that would be that. I cant imagine any of you in that situation would be screaming, moaning, and demanding in the store. The truth is this was a high demand item and there was a slim chance anyone would get it. Dont look a gift horse in the mouth people.
Silvermyn and Pfffft, I'm only saying what I have been told by a friend, I am not advocating litigation, I'm sure it will be sorted. Tone down the replies please.
My mate, who is a lawyer, asked me if my Banksy had arrived, I told him the deal and he gave me his opinion. The problem with their T&Cs is that they would have to prove you had read them. Now I can't remember whether I was asked to confirm that I had read them through the buying process but I don't think that I was. If not, they would have a problem enforcing them.

Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 15:07:36 GMT 1, pffffft mate, way over the top. No one (certainly not me) is saying that they deserve anything. POW have offered it to some people, i think the concern for me would be that they dont offer it to everyone. As i said, i havent heard anything so as far as i know i could still get the NOLA print i bought, and i will be one happy little monkey. If i don't, and if i am offered the next one, i will also be a happy monkey to be given the oppurtunity to buy again. If they offer that to some people and not to others then why shouldn't i get a bit pissed?? why is someone elses custom considered more important than mine??? anyway, as i say i still haven't heard anything, so keeping my fingers, toes, and eyes crossed....

Nothing personal but I'm not sure I would hire your friend as an attorney. I buy heaps online, every time I make an online purchase I am not prompted to read the T&Cs. The T&Cs are there to protect the business.
Regardless of whether you had read the T&Cs, the truth is they are on their site in black and white outlining their rights.

schlomo, my apologies. my response wasnt directed at you, you've been well grounded about this matter. there have been a few who have been a bit over the top about it, their demands, lawyers, etc
My understanding is they will offer all of the thursday buyers, unless you're one of the people on POWs black list for flipping etc. I really think POW are doing their best in this honestly, this apparently happened in the past with Morons, Trolleys, & Grannies and quite simply people were just told they were oversold and their orders cancelled. This time around people are being offered a form of compensation and some are a bit over the top in their additional "demands".
Did you email Dora your order number? Were you one of the ones refunded on thurs?

100% agree i only got a reply from dora telling me my order wouldnt be reinstated no future banksy promised too
i think it will be better for us to know how they decide which order would be reinstated, i used to think they would just follow the order no., reinstated the lower order no. first, but right now seems like that's not the case
pffffft mate, way over the top. Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 15:21:14 GMT 1, Ah, sorry then pffft, i misunderstood....
I have emailed and heard back from Dolly. All she said was they were trying to sort things out and would be in touch again as soon as they had. I haven't emailed again since, as don't want to give them more emails to answer! I may well email again on Monday of next week if i still haven't heard anything back.

Banksy NOLA Print on POW, by liveforever on Nov 27, 2008 15:22:30 GMT 1, Silvermyn and Pfffft, I'm only saying what I have been told by a friend, I am not advocating litigation, I'm sure it will be sorted.
I couldn't comment on US law but in the UK once you have a receipt and a print number, that object legally belongs to you. POW are entitled to have non standard T&Cs but they have to make you aware of them. By not actively doing so they leave themselves open to people saying they weren't aware of them.
Hopefully not relevant here but it's worth knowing when you buy online

Banksy NOLA Print on POW, by njr911 on Nov 27, 2008 15:28:43 GMT 1, that's not correct, there is no contract until the item is posted. In the T&Cs and been tested in the courts.
