Banksy NOLA Print on POW, by kel on Nov 27, 2008 15:31:05 GMT 1, I cant understand why everyone is still going on about this all I say is well done to those that got one unlucky to those that failed. Though you really do have to get over it. If you had £450 available to spend on a print then you could have bought in the last week.
Lucy McLauchlan - Just a bit of fun - £85 Dan O'Connor - 1 of 10 hand drawn images - £35 Cept - Fly Wonder - £150 Prefab - Roller - £97 Eelus - Raven Haired Print - £100
All of which would look amazing on the wall. Or is it more the fact that the Bansky pictures will be worth more in years to come and that all those complaining are actually in it for monetary gain.
Oh and I didn't get a Nola either so decided instead to buy the top 4 out of the list above and indeed am very happy.

Banksy NOLA Print on POW, by schlomo on Nov 27, 2008 15:31:59 GMT 1, I do think we're going a little too far here! POW are a great team, and they'll do what they can to sort it out. I'm sure the reason i, and many others, haven't heard back is that they are still sorting out all the problems, and as soon as they have done they'll be in touch, either way.

Banksy NOLA Print on POW, by liveforever on Nov 27, 2008 15:32:14 GMT 1, that's not correct, there is no contract until the item is posted. In the T&Cs and been tested in the courts.
I don't want to drag this on but you sound like you know what you're talking about, any more details? I'd be interested in seeing what my mate makes of it.

Banksy NOLA Print on POW, by rosstierney on Nov 27, 2008 15:32:23 GMT 1, honestly guys, if your duplicate print is numbered +240 then you've got no chance of it being re-instated.
contact pow by replying to your original receipt 'POW - Purchase Order Ref: xxxxxxxxx' mention the forum & leave it with them
i'm sure they will have no problem guaranteeing you the next print & be grateful, as far as i'm aware this is the first time they've compensated

Banksy NOLA Print on POW, by pfffffffffft on Nov 27, 2008 15:34:08 GMT 1, I couldn't comment on US law but in the UK once you have a receipt and a print number, that object legally belongs to you. POW are entitled to have non standard T&Cs but they have to make you aware of them. By not actively doing so they leave themselves open to people saying they weren't aware of them. Hopefully not relevant here but it's worth knowing when you buy online
Can you link me to the statute or case law on that statement? I'd be curious to see that law, just because you have a receipt and a print number, doesnt mean you are entitled to it if per se the print was released in error (like friday) POWs T & C clearly state:
The entire risk as to the results and the performance of the information is assumed by the user, and in no event shall Picturesonwalls Ltd be liable for any consequential, incidental or direct damages suffered in the course of using the information in this archive.
POWs T&Cs are pretty standard actually. Compare the T&C for ebay re:liability vs. pow.

Banksy NOLA Print on POW, by jellya on Nov 27, 2008 15:36:21 GMT 1, POW are doing way more this time to say 'sorry' for the over-ordering. For all the LA releases and S&S there were no promises made for future print reservations, and they were not obliged to do it this time around. These are like golden tickets folks and those that have them should be absurdly happy.
I think this marks a sea-change in POWs customer service and is something really positive as next time you or I could be effected.
That said I do think that POW should do the same for all those concerned (re: Friday buyers), and who's to say that they are not working something out right now.

Banksy NOLA Print on POW, by silvermyn on Nov 27, 2008 15:40:36 GMT 1, Did your lawyer read the POW Terms of service? Quite simply pow can cancel any order at any time and they dont have to give you anything. www.picturesonwalls.com/Terms.aspI suppose legally it is within your rights to demand it, but legally POW doesnt have to give you anything. Honestly, I havent seen anything like this. Last year I waited online for a wii, if I had gotten to the front of the line and they had sold out well, then that's that. Even if they had rang me up totalled me out and then said, oh crap, in the time we were ringing up your order it sold out, I am sorry, we will have to refund your money then that would be that. I cant imagine any of you in that situation would be screaming, moaning, and demanding in the store. The truth is this was a high demand item and there was a slim chance anyone would get it. Dont look a gift horse in the mouth people. Silvermyn and Pfffft, I'm only saying what I have been told by a friend, I am not advocating litigation, I'm sure it will be sorted. Tone down the replies please. My mate, who is a lawyer, asked me if my Banksy had arrived, I told him the deal and he gave me his opinion. The problem with their T&Cs is that they would have to prove you had read them. Now I can't remember whether I was asked to confirm that I had read them through the buying process but I don't think that I was. If not, they would have a problem enforcing them.
My apologies liveforever, I did not mean for that to come accross the wrong way

We're talking about buying the print and then having money refunded, not missing it. POW also released a statement on this thread saying those that have had their money refunded will get a chance to buy the next one, thats why we're talking about it.

Banksy NOLA Print on POW, by Daniel Silk on Nov 27, 2008 16:46:47 GMT 1, Bump
Bump for today Official statement from POW regarding the release:
We would like to apologise to the people who received a refund on Thursday. Our database was overwhelmed with people adding to basket at exactly the same time & a small number of prints were allocated twice. The small number of prints that became available on Friday were related to something else & clearly those prints should never have been made available. As a result all of those orders on Friday have now been refunded. We extend our apologies to those customers as well. We have been able to to re-allocate all the prints from Friday's refunds & prints destined for Ebay sellers to customers who were refunded on Thursday. We hope to cover all the people who were refunded Thursday but if we don't they will be offered the opportunity to buy a Banksy print in the future. We thank you for your continued support & understanding. Best regards Simon@picturesonwalls.com

Hope the next print will be a killer one .....Wonder how many we are by now.. Have you or any of the other Thursday 'losers' had a offer from POW to buy the next print?? Dear Customer
As you may already be aware a number of orders for Nola were duplicated by our database system. Unfortunately your order is one of those & because the database did not recognise your order we have had to refund it.
Following some ebay refunds & Friday sales refunds we have still not been able to re-allocate you a print.
I sincerely apologise for this.
We would like to offer you the opportunity to buy the next Banksy print, the details of which will be known fairly soon.
This offer will come by way of an email directing you to a payment page.
If you do not want to be offered this chance please reply by return, otherwise you do not need to do anything.
I would like to thank you for your understanding & continued support & apologize once again for the obvious disappointment at missing out on Nola.
Kind Regards
SIMON DURBAN MD

No offence, but your friend must be a pretty s**t lawyer. This is basic first year law degree stuff.
Placing an online order in this manner is only akin to going into a shop and carrying an item to the checkout, then placing a wad of cash on the counter. The retailer is free to reject or accept your offer as it sees fit.
POW does not have to prove that you read the T+Cs, common law principles are sufficient.

Banksy NOLA Print on POW, by alsbabar on Nov 27, 2008 16:55:03 GMT 1, you know, with all this bickering and bitterness, why should POW bother to offer anything to anyone - perhaps they should have made the print available to those who were prepared to make an effort for it, ie travel to Bethlehem or some far arsed place. Dont come back at me with, "well some of us don't have the time or money" crap, because those who do, have enough time to F5 for 3 days non stop or bitch/complain for days on end about missing out.
POW have acknowledged that they had some issues with duplicate prints - they have apologised, and let that be the end of it. Now someone please lock this thread!!!

If anyone's interested in trading their Nola for the next print (once we know what it is) perhaps we could talk?
Or maybe I'll just sell on the payment link POW send (joke)

Had an email to confirm but not counting my Chickens until the postman knocks at my door.

Banksy NOLA Print on POW, by kel on Nov 27, 2008 17:31:54 GMT 1, Thats a good offer by POW. Good on them. Provided we like the next print - I really like Nola If anyone's interested in trading their Nola for the next print (once we know what it is) perhaps we could talk? Or maybe I'll just sell on the payment link POW send (joke)
I am fairly certain that when the next print comes along you will prefer that one more. If your honest do you think that Nola was seriously the best print this year. And if your still not happy with the new print I will give you £300 on top of the cost price now for it.

Banksy NOLA Print on POW, by ©hief' on Nov 27, 2008 17:36:20 GMT 1, so have all thursday buyers had this email? and all friday buyers, bad luck, they are not extending this offer to them
Bad luck? Why is this offer not extended to the Friday buyers. They should be entitled to the same offer also. The prints bought on Friday morning were released by POW and bought fair and square ! It's not gonna hurt POW to compensate the Friday buyers also.
Come on POW!! do the right thing !!!
