Interesting read if you have the time and effort. According to that 'guide', adherence to which is essentially optional i presume, should these have not been labelled as 'reproduction'?

Couple things to reply to:
Nothing is official in the art world. There exists no regulatory commission, or group of law-men that hold everyone to this. However, there are certainly very specific norms that people in the industry, particularly respected people, are expected to adhere to. If these norms are not adhered to, then it is generally at the cost of reputation, sales, etc... If you don't adhere to the very basic principals behind these collective "norms", then you are shooting yourself in the foot, in a manner of speaking. Furthermore, there is a lot of pressure put on the publishers to adhere to these "norms".
Also, there are no ethics to artwork, but there are ethics that surround the context of the artwork. Noone in the world can ignore that fact. We aren't talking about the artwork here, we are talking about the markings on the artwork...
