i think lee is your man - for this... perhaps the story may not be too savoury.
nice image - slightly tarred somewhat by the potential seller.
lee ? expand / discuss / splutter forth ?

Banksy Barcode Shark, by silvermyn on Nov 5, 2008 18:40:38 GMT 1, I saw this on US Ebay a few months ago. The story was that it was from the LA show. I think he wanted $80k for it but I'm not too sure on that.
It will be interesting to see what this sells for because it is a super-cool image.

Banksy Barcode Shark, by lee3 on Nov 5, 2008 18:59:42 GMT 1, It is the same barcode shark as the one that was offered on ebay at 60k, then 100k, and then 120k. I expressed interest with seller at around ~70k but he played all kinds of games with it including sending along an estimate from Bonhams to all interested parties in an effort to get more out of them. At the time, with Derek Baurmann i was working on getting a slightly larger Barcode leopard canvas from the same show and i personally preferred that image over the shark (though i do love them both). It was MUCH easier and enjoyable working with Derek and as that deal looked more and more likely, i bowed out of the running for the shark. That's when the seller kept asking me for an extra $5k just to get the deal done. I believe i posted the details which I'm a bit fuzzy on in another thread when this was on ebay in August I believe.
To be frank, the seller didn't really display the canvas well and had it hung like a diamond to keep the shark horizontal which I had a difficult time with. I much prefer it hung like this and presume the orange or red stencil signature is on the right overflap like the rest of the works from the Existencilism show. If money were no object and I had my choice, I would grab the larger one where the shark is horizontal that Laz has for sale but it's awfully pricey.
I will be surprised if this hits the $100k minimum given the environment and the fact the shark is pointed an odd direction. It does help that it's numbered 1/1 but I don't think that is enough to get a $100k bid which translates to a $120k sale. This seller just wanted cash and I tried to point out to him that he would be far better off taking $70k cash as opposed to putting it to auction but it was no use and i didn't really pursue it that strongly.
He paid $250 for it originally in '02 and suppose it went at the high end and sold for $150k including premium. Back out $30k for buyers premium and another 7% (guessing) sellers premium at $10.5k nets the seller $109.5k AND a 1099 form from Bonahms where he'll owe 29% collectibles tax federally ($31.7k) and another 8% for CA state tax (8.7k) for a after tax pocket of $68k to the original buyer. Mind you this is on a $150k sale price which I doubt will ever happen.
Nice piece, a weird seller, and an unfortunate time to be selling art relative to the past 5 years though it may well be the best time to be selling art over the next 5 years.

I didn't think summer was speculative at all. In fact, I was quite envious of some of the prices paid for certain images. If you run an artnet report you can see that the speculation hit a fevered high for Banksy somewhere between October of last year and February of this year. Prices are off a good 50%+ for many canvases in less than one year which is a great thing for those who wish to add to thier collection.

Banksy Barcode Shark, by bobbymeachamjr on Nov 5, 2008 19:48:23 GMT 1, Yes, the summer was already showing some downward weakness from the peak. However, I think the overall psychology = speculation regarding Banksy was that he would "hold steady" as evidenced by this particular seller. Personally, I'm glad that I didn't pull the trigger on a big work earlier in the year. I can partly thank my investment banker siblings who forewarned of a dire situation ahead...

Banksy Barcode Shark, by lee3 on Nov 5, 2008 20:03:41 GMT 1, For those of you perusing the acutions for potential additions, save yourself the excitement that I had on the following yesterday:
www.artnet.com/PDB/PublicLotDetails.aspx?lot_id=425830385
At first my mouth hit the floor at what looked like an enormous 30 inch by 60 inch diptych Girl with a Baloon that would obviously be unique in that format with a very nice low teaser estimate. I figured to myself that it could go for 2.5 to 3.5 times the low estimate even in this environment. I placed a call to PdP looking for a condition report and was dissapointed to learn they wrote the wrong measurements down and it's not 30x60 inches side by side, it's 30x60cm and therefore one of the edition of 25 from '06 (it happens to be #17 with a hand signature on the reverse of the girl canvas and a stenciled signature in red on the right over flap of the balloon canvas). He said I was the first of what he expected would be many disapointed inquires regarding that lot.

Banksy Barcode Shark, by loucastel on Nov 5, 2008 22:32:15 GMT 1, Looks like it could be quite an interesting sale at Bonhams, they have a few nice works going under the hammer, the New York office seems to atract some top class art, was a bit suprised to see some Dface in the sale, just wondered if America had heard much about him yet! I think the Radar Rat will be a good barometer for prices in the current climate,

These particular canvases are from the diptych edition which is also numbered to 25 and each canvas (one the girl, the other a balloon) measures 30 cm square, not to be confused with the other edition which has both the girl and the balloon on one canvas measuring 30 cm square. I don't know whether they were done in '05 and '06 or just '06 but i do know that the diptych one that is offered at PdP (#17 of 25) is signed and dated '06 on the reverse of the girl canvas. So, there are at least 3 different editions of GWB and I'd bet that there are some unique ones too.

Banksy Barcode Shark, by stjohn on Nov 6, 2008 13:26:52 GMT 1, In Bonhams's Ts and Cs it says this:
"The term โpurchase priceโ means the aggregate of (a) the bid price, (b) a PREMIUM retained by us and payable by the purchaser EQUAL TO 20% OF THE FIRST $500,000 OF THE BID PRICE, AND 12% OF THE AMOUNT OF THE BID PRICE OVER $500,000, and (c) unless the purchaser is exempt by law from the payment thereof, any California, Arizona, Illinois, Massachusetts, Nevada, New York, Pennsylvania, Texas, Washington state, or other state or local sales tax (or compensating use tax) and other applicable taxes."
If we in the UK bid and win, what is the NY tax, or are we exempt if it is for export to the UK, in which case we pay out own duties/tax on import?
Anyone know? Thanks.

Banksy Barcode Shark, by Heavyconsumer on Nov 6, 2008 14:05:53 GMT 1, I think only buyers in NY pay NY sales tax. But if bidding from the UK, I would suggest checking for any taxes involved in importing the item. If buying something that originally came from the UK, from a seller in the USA, I believe we have to pay about 5% import duty, as opposed to full blown 17.5% VAT.

So long as you dont bid at the auction you are exempt from NY tax. Considered an export.
In Bonhams's Ts and Cs it says this: "The term โpurchase priceโ means the aggregate of (a) the bid price, (b) a PREMIUM retained by us and payable by the purchaser EQUAL TO 20% OF THE FIRST $500,000 OF THE BID PRICE, AND 12% OF THE AMOUNT OF THE BID PRICE OVER $500,000, and (c) unless the purchaser is exempt by law from the payment thereof, any California, Arizona, Illinois, Massachusetts, Nevada, New York, Pennsylvania, Texas, Washington state, or other state or local sales tax (or compensating use tax) and other applicable taxes." If we in the UK bid and win, what is the NY tax, or are we exempt if it is for export to the UK, in which case we pay out own duties/tax on import? Anyone know? Thanks. So long as you dont bid at the auction you are exempt from NY tax. Considered an export.

Not being funny, but how do I get a piece from the auction without bidding!
