Although I have tried to negotiate amicable solution IMO it was pretty clear from some of the response that this would not be possible and therefore after giving him to plenty of opportunity to resolve it I finally decided a small claim was the way forward. The cost was £25 and to be honest it is well worth it to stop the "I have spoken to trading standards and it is Buyer Beware" type replies and general annoying delaying tactics in hope I will forget it. He also wanted me to return it at my own expense before any refund was considered, but given some of his replies I would rather keep the evidence until a judge decides on when it is returned.

Unfortunately the damage IMO was not minor and it was paid for by Paypal gift so no chance to recover my money there.
At the time (although it was only £50 to me it is not small change) the way the dialog was going a small claim was the only option, I had been trying to seek a compromise from the start, firstly by saying I may be able to frame the damage out and at that stage may have been open to some sort of partial compensation via a claim from the Royal Mail, then by asking for the sellers address so I could send back the poster and receive a refund after he had it back. But as the affair ran on and with each delay or reply I felt forced into taking a more hard line, until and after plenty of warning I took the option of starting a small claim (a Buyer Beware comment was the final straw). As it was I never wanted to escalate this to a claim and this could and should have been avoided with a little more understanding and trust. However I have had a couple of incidents in the past when a claim was the only solution (once with and eBay purchase and once with a insurance claim from Parcel2Go) and to be honest this deal had seemed to be starting to be following an all to familiar pattern.
When deals go wrong it is important both parties are reasonable and do their best to resolve it quickly and amicably, but when this doesn't happen sometimes a PayPal claim (when it isn't a gift payment) or an online small claim may be the best option on principal.
The good news is that the seller is now IMO being a lot more reasonable and made a partial refund, so after a little negotiation we should be able to resolve this and I will be able to cancel the claim.

Anyone who hasn't heard of the UK Government Money Claim Online service it can be a good way of resolving disputes fairly when there appears to be no other solution, Paypal gifters take note.
