In this case I was the unlucky person to actually end up buying this poster and as it arrived quite badly damaged I contacted the seller but have no luck getting a refund, so giving him plenty of time to put things right this is now going to have to go to the small claims court to make a judgment. So beware of buying from this member, it has not been the usually pleasant experience I have encountered from all of my other dealings with other members on the forum .

Calm down son! I doubt you are far enough down the line for court action just yet given it is less then a month since you even bought the print! A court will require that you try and negotiate a settlement first which will ordinarily include giving a minimum period of one month for a party to respond to an initial claim.
In any event you don't get to choose to go to the small claims court this is decided during allocation. If you want to make him realise you are serious I would send him a completed claim form stating that it will be lodged if you don't get your money back. Fee for lodging is ยฃ35 though so I'd ask yourself is it really worth it!

He also wanted me to return it at my own expense before any refund was considered, but given some of his replies I would rather keep the evidence until a judge decides on when it is returned.
