Banksy • Choose Your Weapon Print, by Deleted on Dec 15, 2010 22:15:02 GMT 1, From the POW Terms page: Secondary Market: In an effort to sell art to people who want it, rather than people who want to make a profit on it, Picturesonwalls reserves the right to refund any person who advertises their print for sale prior to them being in receipt of said print. For the avoidance of doubt, we deem the contract between seller & buyer to have been made at the point the print leaves our premises and not the point of payment. If a print is offered for sale on the Secondary market after receipt, then Picturesonwalls reserve the right to no longer fulfil any orders to that customer. Ah ok - learn something new every day Wouldn't stand up in law though - consideration (ie payment) confirms the contract and sadly the terms above would not be considered 'reasonable' in law. Be interesting to see if they ever exercise this right
The sales of goods act is essentially designed to protect the consumer (customer) and is weighted toward the consumer.
I think this is about tender and acceptance - goods were offered for sale and bought therefore accepted. You could dig a pretty deep hole with the T&C's I think as they are weighted towards POW are therefore unfair in the definition of the unfair terms and conditions act of 1977?
Above all, it's a piece of paper with (currently) no COA or blindstamp. Caveat emptor.

Banksy • Choose Your Weapon Print, by Wearology on Dec 15, 2010 22:29:30 GMT 1, If an individual buys and item than sells that same item for a large profit - is that individual who made the large profit responsible to pay any taxes on the profit such as capital gains, federal, state and or local taxes or is that only in America? I am assuming the individual paid taxes to POW, POW paid their taxes and that EBAY paid there taxes on it what about the guy who is going to make the most money.

Banksy • Choose Your Weapon Print, by naughtyshorty on Dec 15, 2010 23:03:00 GMT 1, Caveat emptor (buyer beware) indeed. i can imagine that this print will be one of the most faked ever - simply due to all of the colourways, the lack of COAs and blindstamp. going to be really interesting to see what happens to it... my contract law is a little hazy... but I do remember that when goods are sold via the internet, it complicates the situation somewhat. There are several examples where a contract has been established, and goods paid for, but online companies have not honoured the contract due to the goods being advertised for sale at the incorrect price. If this happened in a physical shop, then you would be able to walk away with the goods for the price advertised if your transaction all went through (ie the shop owner agreed to sell them to you at that rate).
I dont think in practice a flipper or anyone would actually challenege pow if their print got cancelled. amongst things, its time, hassle, legal fees etc..
looking forward to seeing pics of the 19th....

In the UK i believe there is no capital gains tax on art and wine as long as you are not a business.

The only time that you don’t pay tax on Art is if its a piece of national importance, deemed to be a chattel with a value of £6,000 or less, or the gain is below approx £10,000. Wine is exempt provided it has an expected useful life of less than 60 years

A few personalities changed quite dramatically once the scrum had started. Very unpleasant indeed. Saw that guy later on Saturday morning at the Berwick Street queue. We eventually kissed and made up.
