IMAGE RIGHTS/COPYRIGHT ETC, by Deleted on Mar 25, 2011 20:07:02 GMT 1, Was wondering if anyone could shed some light on something I'm curious about. If you buy a painting etc, to what extent are you allowed to reproduce an image of it. Not thinking cups, mugs, t-shirts and coasters etc or using it "illustratively" , more, if I photograph it, including the frame etc, then as with most photography, are the image rights to the photograph and by default, the image mine ? without frame, close up etc.. anyone any idea ?

No idea about the legalities but I bought an original once and the gallery came back and ask me if they could produce a print from it.

IMAGE RIGHTS/COPYRIGHT ETC, by svenman on Mar 25, 2011 22:37:05 GMT 1, the rights to the photograph are yours, but the artist retains the intellectual rights of the image she / he created in terms of ownership and reproduction no matter whether you have bought the original work or not.... i believe. are you thinking of making some snide t shirts, coasters and mugs?

IMAGE RIGHTS/COPYRIGHT ETC, by svenman on Mar 25, 2011 22:38:38 GMT 1, if a gallery contacted you about making a print of an image of a piece you bought, then it was only done as a courtesy. you have no intellectual property rights just because you bought a painting.

IMAGE RIGHTS/COPYRIGHT ETC, by balibob on Mar 26, 2011 11:36:44 GMT 1, Intellectual image rights remain with the artist whilst alive, unless the rights are sold, and then with his/her estate heirs for 70 years after his/her death. It would be iilegal to reproduce for profit without authorisation. Reference Shep Fairey vs AP.

Yeah, I understand that, my question is where the line is between the rights of the photographer and the rights of the artist.
A few cases
If I take a photograph of street art, the rights are mine as the photographer. Does street work fall under the artists image rights or the photographers ?
If I have an art collection, to what extent can I use this. Website, advertising, Photo of me with the work, documenting the work and using the collection to promote other activities etc. Corporate art collections for example.
For example. If I build a corporate art collection, to what extent can I use this to "advertise" the brand.
So many blurry lines..

Yes, was thinking of setting up a little market stall called "mugs for mugs" with images of street art
Case studies : Brand, "SVEN SPORTS"
1) Website showing your collection. The "SVEN SPORTS" art collection.
2) Website showing your collection. The "SVEN SPORTS" art collection, but is integrated into your main website with parts of the collection used to illustrate your "brand", "adverts", "internal reports" etc.
Ok, just spoke to a great chap on the phone who has cleared things up, basically, you can't do shit :-)
