legal question about Bankys topics, by Michael Jacob on Nov 1, 2006 21:35:54 GMT 1, Greetings all, I have a vague legal question. Im some of Banksys artwork, he uses images that definitely arent his. Like HMV, Golf Sale, Pulp Fiction, Napalm, etc. Im sure some of these are copyright protected.
Im going to start screenprinting myself. I love Banksys style and just ordered all the equipment to do it. Im curious to the legality of using someone elses photo and manipulating it into art. Is that ok to do. I know Warhol did it, as well as many others in the past.
Thoughts please. Thanks!!!

On a more practical note - who is going to bring a claim against you? I suppose disney and maccy d's might for napalm but whoever owns the copyright for the hmv, tarantino, etc images probably like the attention (check out bt's take on the phone box) and let's face it, if you're prepared to go out and spend (presumably a lot of) time graffitiing the side of a building you probably don't care too much about someone bringing a claim against you for breach of copyright

That really doesnt make it "absolutely fine" for this bloke to bang out granny repros if he's fanices it though does it? (if that is is even what he is hinting at??) And pedro, if what you say is true about legality because Banksy remains anonymous is one thing, If its a straight copy thats being done then surely POW hold copyright of that image anyway? And as fans, we wouldnt like to think bob is printing them off in his tool shed and making a ludicrous profit passing them off as the real thing (which I am sure is only a matter of time anyway until we are flooded with high quality reproductions on a grand scale).

But a whole different thing if he is scanning a lifesize repro of Grannies (for instance), cutting exact size screens, printing it on the same, or similar stock, buying a stamp etc. Surely copyright comes into play, just at what point is over my tiny head! And I work in print and deal mainly with publications.....oops
All art/every image borrows from something done/existed previous if you look hard enough anyways.

I in no way want to copy or duplicate anyones artwork. I grew up with parents who were art teachers, my sisters a art teacher, and Im in graphic design. Im in the United States. I want to use political images (ie the President, armed forces imagery, etc) and some other images. I would like to take images from the news or magazines and incorporate them into my artwork (like Banksy has done).
I DO NOT WANT TO COPY ANYTHING LIKE GRANNIES. If you want my honest opinion, I think 60% of Banskys work is very good. 10% is very boring, 10% is mimic and 20% is pure genius. Its the 20% that will hopefully allow him to continue on a upward trend. Ive been following him a while now, and I hope his success doesnt goes to his head, but instead goes to his soul. Hes good very graphic ways in telling his stories. His images are simplistic but the meanings are complex. I applaud him!
So, now that Ive hopefully cleared my intentions, can you guys still help me?
