For this customer, I say give him a refund on the print less (no refund on postage) and hope that he/she appreciates the gesture and orders from you in the future. Good customer service goes a long way.

Mine arrived today and I was hoping that the print in the flesh would be much better than the one on the web page......am afraid I was (very) wrong.
I dont want a refund but I did learn a lesson!

To a degree. There's some debate how far the DSR currently applies to Ebay. Auctions are one of the exemptions under the regs and therefore items listed in auction format almost certainly fall outside the regulations. Though B.I.N. items are likely to be caught. It's also worth remembering sales by private individuals not acting for business purposes are not covered by the DSR.
Studiocromie - you're based in Italy aren't you? If so, it's worth consulting an Italian lawyer and having them draft some simple Terms and Conditions for your website and explaining the basics of consumer law to you.

I have to say that I agree jffriedman that customer service goes a long way and the buyer should be refunded in this case. The whole release of this print was too shambolic for my liking and put me off buying it altogether although the second image looked to be a big improvement than the first one they put up. Would anyone be kind enough to post some pics of their Everyone Has a Price print in the appropriate thread so I can see a truer representation? Thanks in advance.
