There of course are loopholes out the wazoo giving buyers ways to get out of it (such as claiming they entered wrong amount, dog ate my wallet, etc).
only way to make them pay would be to sue them? doubt it would go far though.

Is ebay legally binding?, by Wiseblood on Sept 25, 2007 23:13:23 GMT 1, Thanks for the help, basically my g/f has a hell of a lot of clothes by lamb (gwen stefanis clothing range, on a side note, we saw her live other night and my god she is fit) i mean a lot, more of the expensive shit, well alot of the early stuff is worth balls loads, she got made redundant, was contract so no pay out just bye bye job so thought she would sell some of her clothes to make ends meet, sold 6 items (about 2ks worth) one buyer bought the lot all buy it nows, hasnt paid and has just stopped making up excusses and not returning emails, this has been going on about 3 weeks. the buyer has about 1500 +ve feedbacks as well. She needs the money and i need her to shut up about it. I dont really use ebay so know nothing about it so cant help

Basically, if the seller sells to another at a lower price than what the breaching buyer had promised to pay, seller can recover the difference. But it's usually not worth the headache to sue and not too many people do. Waste of time. Can't recover much.

I'd file a non payment with ebay to claim your fees back and move on. You've been more than patient.

Its s**t I know but I think re-listing the items and notifying ebay of the buyer's failure to pay is probably the best option.
