damaged print estimate, by scud80 on Jan 18, 2007 2:50:16 GMT 1, i recently bought an unsigned hmv on ebay and it arrived damaged. the tube it was sent in was totally inadequate (the walls were maybe half or 3/4 of the thickness of those used by POW) and got dented in transit which damaged the print inside. the damage isn't what i'd call severe, but it's easily noticeable in 4 places (two of which are about 8cm long). in addition to this, the print was wrapped in newspaper and not prevented from rubbing against itself so there was a little bit of ink transfer from the front of the print to the edge of the back where it was rolled.
so, my question is ... how much of a refund do you think would be appropriate for this transaction (as a percentage)? the print wasn't insured ... actually insured shipping wasn't given to me as an option.

not sure what the process is for sorting yourself out here. technically you should have asked for the shipping to be insured, and if he declined you should have walked away. he doesn't have to offer it. however i'm not sure if he can be done for not packaging the print properly? have you contacted him about it, is he willing to compensate?
there might be some useful help sections on ebay, but I can't believe he didn't give you the option of special delivery at ยฃ5-ยฃ8 (which i'm guessing you paid roughly for uninsured).

Difficult one if you signed for it, it could mean you signed for it as being delivered in good condition, this releases the postal service used from any liabilitiy. Have you spoken to the seller ? I mailed a Banksy to the US which was damaged in transit. So I refunded the money, seemed the rioght thing to do. It should never be the receivers problem IMO. If you have no luck then try for a full refund through paypal or your credit card company.

I have some Warhols, Chagalls and a Picasso. I only collect less than perfect ones, becuase thats all I can afford. The art collecting community really like mint condition pieces. Its just like coins or baseball cards... the mint ones command the most by far! How can you be responsible for it, it you never had it in your possesion? IMO its the property of the seller until you get it. If they wont take a return, try to get as much as possible knocked off.

that is very unfortunate. I had a similar experience wheni bought "I fought the law" which was not put in a heavy duty roll and so it got damaged by royal mail, who apparently just put heavy items on top of poster rolls... smart eh?
Anyways luckily it was insured and I got a full refund from the seller. The problem is that without insurance you will not be able to get anything in terms of compensation back, unless its from the seller, because on the royal mail website, they state how things should be packed... (just to seal up their end)
it was a pain to go though and I am sure you have to also... Shame for the persons involved and shame for the print itself.
