Mike try calling the FSA and explaining the situation to them. They are very good in sorting out genuine cases..
Calling/emailing PayPal is a waste of time...I took me a almost year & 30+ phonecalls to get money they took from my account.

If you sent it special delivery, then get him to send it back (again via special delivery) and refund him.
Then put a claim in with royal mail. They take fucking ages to deal with it (especially if it was an international one) but as long as you have the ebay page (print it NOW and save it) and the original pictures pre damage, and take pictures of this new alleged damage then you should be fine.
It may have been opened or damaged in transit, or he may be talking cobblers. who knows, he might even have opened it, trashed it, or done a switch for a damaged one he already had.
he does sound a complete twunt though. Please post his user ID so we can look out for & block him.
Ps- 2 weeks??? who the hell signed for it while he was away, and who is to say they didnt open it in his absence?? Something stinks...

Help please?!, by Danger Mouse on Aug 30, 2007 16:02:12 GMT 1, I have a similar problem but this time I am the buyer. I bought a print back in May through paypal using my credit card. It was sent from the US to my parents address in the UK as I am working out of the country. I haven't been able to return to my parents address until last weekend for a number of reasons and so only checked the print for the first time then. The print was really well packed in a tube and the tube sent in a box with lots of foam padding. I took the tube out of the box and took the plastic cover off of one end of the tube and before I even started to remove the print from the tube I could see that the end of the print had been squashed by the plastic cover. It looks like the print was too close to the end of the tube and so when the seller placed the plastic cover on the tube he squashed the print in the process and due to this was unaware that the print had been damaged.
I contacted the seller and told him the news including photographs of the damage and he emailed me back saying he was surprised and shocked and that the print was in perfect condition when he sent it. I replied explaining that the damage was visible before I had even laid hands on the actual print and told him I thought it was due to the plastic cover as mentioned above. He replied saying basically tough luck!! I have sent him a number of emails since the weekend and have no reply to them what so ever. He is now ignoring me!
I have since contacted paypal but found that I am only able to file a dispute within 45 days of the transaction. So paypal are unable to help. I also contacted American Express who told me I would be insured but because the purchase had been made just over 90 days before I contacted them then they could also offer me no help/insurance. I therefore feel really trapped. The seller has sold me a damaged print and is unwilling to help me, paypal can not help me and AMEX can not help me. I now have a damaged print that I paid approx 3000 GBP for that is now no doubt worth less. I feel totally ripped off and p**sed off as I used my savings to purchase this print.
I wish I had of been able to get to my parents earlier to check the print but for a number of personal reasons I was unable to.
Any thoughts/ideas on what I can do to resolve this?

I agree. When I purchased the print I contated AMEX to make sure it was insured through them and they said it was. I therefore used them as the insurance rather than paying for insured post and having to declare the value of the print and getting stung with a customs charge. I feel so f**king unlucky that I missed the 90 day policy by just a few days but I was unaware of this until it was too late.

I have come across this a couple of times and this is what I now do.
Firstly I put this disclaimer on all my auctions
"I will not be held responsible for any lost or damaged items but will help as much as possible with any claim you wish to make"
This straight away puts off any scam artists out there and you can use this if anything happens as it was part of your description.
Be carefull with getting the buyer to send the item back to make a claim. When you start the proceedings with Royal Mail they will send you a letter saying that the item must be with the buyer for inspection or the claim "could" become invalid. Tell them that you will re-inburse them once your claim has been successfull.
What to do is to send the original receipt with the tracking number to the buyer and get them to make the claim. make sure you keep a photocopy of this as Royal Mail and some buyers have a habit of losing things or saying they haven't received it. Actually just keep copies of everything. Whatever you do if you agree for the buyer to send it back to you make sure you check the print before signing for it to make sure it's the one you sent. This will annoy the postie a bit but ces't la vie.

yes Don't wait several months to check the condition of the print and then ask for a refund! Couple of weeks I could understand, but months? No way pedro- you would havce exactly the same response from me after that amount of time. You could at the very least have got someone else to open it for you to check it non? Especially something of that value!

All my family have either Black or Platinum AMEX cards and have for years, however we've got a big problem with them at the moment. It's a long story mate which I can't really discuss as it is still ongoing and looks like going legal with AMEX and we're going to the US and UK press (as the problem happened in New York) so you'll either read about it soon or I'll let you know (if I can) when we're sorted.

I have to say that after having a platinum and now a black card that they do come in to their own. And you would be surprised how many shops take them. The rule, as with any credit/charge card, is if you keep paying your bills then there will be no problems.

-Platinum- ยฃ300/yr fee, & a personal income exceeding ยฃ40k/yr -Centurion (black) is invite only- generally you have to put upwards of 250k a yr through your amex cards ( although it varies from person to person and is not set in stone) and the fee is hovering around 2k/yr.
Both have no preset spending limit
Various benefits like very comprehensive travel insurance for cardholder+ all supplementary card holders, hotel gold cards+upgrades (hilton being one of them), airline partners, airport lounge access, car rental benefits (upgrades+ ALL car rental insurance covered), full 24/7 concierge service, fine hotels/restaurants reservations, upgrades, and a load more that is basically too much to list here.
Exceptionally useful for anyone who travels a lot (me!) - the fee pays for itself in travel insurance savings for myself and my family and is a godsend as I fly BA and their current success rate with luggage isnt great really... Concierge is useful for scoring tables at popular restaurants or concert tickets etc

Tell them, if you think so, that this guy is scamming, that you sent it in mint condition, etc....(would of course be best if you had pictures of it pre-posting). Paypal will check into his history if he has one with them (if you get the right person at Paypal), and then you might have a shot. IMO it always looks better to be the first to fight it. Don't wait for him to put all the paperwork in motion. And normally I don't think it's a good idea to post ebay users IDs on this forum, in case people are creep and take advantage, but maybe this might help, posting his ID. If he's buying and selling this type of art surely someone else on this forum will have a story or two of their own.
