Help please?!, by nikki27 on Aug 30, 2007 8:48:20 GMT 1, Just got this email this morning via ebay and really concerned as when i posted the print was in 100 % perfect condition, I had only removed once and there was padding in both ends. Can anybody reconmend the best way to sort this out?
" ive just returned home from holiday and picked up my print, hence the delay in responding/leaving feedback. i am very disappointed with the condition, which is not 'MINT' as stated. i am sure you are aware of the scuff at the top edge of the print which has left the paper damaged. on top of this the print was not padded at the ends leaving it free to bang about from side to side in the tube.it is a miracle it wasnt further damaged. it is clear that the print was damaged prior to posting, not during transit, and it is clearly not mint. i could not sell this on honestly without mentioning the damage and so by accepting it i would automatically make a loss. it is for these reasons that i wish to return on the grounds that the print is not as advertised and is in fact damaged. i request your address for return for full refund. if i have not heard back i will pursue through the ebay channels. your soonest attention appreciated. regards,j.

Help please?!, by ร
gent รacardi on Aug 30, 2007 9:37:51 GMT 1, You say the tube was padded, but the buyer said it wasn't... so who's right? If you did pad the ends of the tube, then it's quite clear cut that the buyer is full of shit. I would ask the buyer to send pictures of the scuff marks that he's describing... but beyond that, I'm not sure what I would do.
I wish I could say more to help you out Perhaps someone else on this forum has had an experience with this and can share his/her thoughts?

Help please?!, by mydeaddogwontwoof on Aug 30, 2007 9:44:10 GMT 1, Ideally buyers should check the print for 'damage in transit' before signing for it, that way you have a case for claiming from the post office/courier, (ideally that is, in reality who actually does?)

Help please?!, by snakes on Aug 30, 2007 9:51:39 GMT 1, Always photograph everything - from print b4 postage, being placed in tube and all layers of padding and also photograph the outside of the tube with address on etc. I may just be paranoid, but it is instances like this that i think it could be of some benefit. Good luck in resolving the issue. Also before you send a refund ensure they send photos of the said damage and make sure you recieve the print before sending the refund..

FOLLOWING EBAY CHANNELS WILL RESULT IN NOTHING.
EBAY IS A FACILITATOR, NOT A VENDOR
IT IS YOUR WORD AGAINST THEIR WORD
CLAIM FROM ROYAL MAIL IF IT WAS SENT INSURED. RETAIN ALL PACKAGING AND RECEIPTS FOR THE CLAIM.

Help please?!, by paulah on Aug 30, 2007 12:42:33 GMT 1, If you only took it out of the tube yourself is it possible there was something you didn't notice? Although I guess if you took pics that time you can have another look. Sometimes these things just happen - either going in or out of the tube - and there's no way of telling afterwards when it happened. As Bongo says - probably a moral decision. If there is a mark though the seller would be right to return it - just don't refund anything until you have it back. Not nice when this happens

Help please?!, by nikki27 on Aug 30, 2007 12:53:41 GMT 1, Thanks guys, Hes from Glasglow.
The next email I recived was this "Hi Julie, Please dont play games with me.I deal in contemporary art under many different guises and have done so for many years. The print was held in place by brown tape and covered inside with a sheet of tissue paper. The print was not padded at either end and was free to bang from side to side. This is some of the worst packing i have ever seen. The scuff is in a position which clearly indicates that the damage did not occur in transit, but pre existed. The only possible way you could not have noticed the damage yourself is if a)you never inspected it, or b)you are blind. Please dont delay me any further, and provide return address as i wish for a full refund. I want to return today as ยฃ478 is a lot of money to be out of pocket. Please respond quickly as i would prefer to avoid ebay proceedures/bad feedback scenario if at all possible. Thanks,j.
Now I know for sure that it was in perfect condition when posted, so I will not be giving a refund. So what happens if no money in my paypal account? Or linked account?
Thanks guys, Hes from Glasglow.

If you have no money in your paypal acc they will put it into a minus & chase through rms debt collection.
I predict he will get a full refund regardless of who's fault it is.
Let us know how you get on.

Help please?!, by nickc on Aug 30, 2007 13:02:39 GMT 1, Hi there, it sounds to me like this person is trying a bit of a scam but without the true facts I can't possibly make a fair comment. What did you reply to him to provoke that second email? Also, why is he saying that he deals under many different guises - that to me would suggest he has something to hide. The problem you have, if you don't have any photos to back up your side of things then it is a case of seeing who blinks first and who needs that stress. If you can afford to, and if you are keen to avoid the stress, then perhaps it might be better to make a one-off offer of a ยฃ50 reduction in the cost of the print and only keep it open for a limited period of time - say 24 hours. If they don't acceot within that time then you are to assume that actually they are happy with the product.
Incidentally, what is their feedback like?

Help please?!, by manchestermike on Aug 30, 2007 13:05:32 GMT 1, If he complains to paypal as not as described they will 'Hold' the money, i will make a guess that he will get a full refund over this ( upon return of print) unless you sort something out which doesnt seem likely with this guy. If theres no money in your account they will put you into -(minus) & if you have other accounts they will * usually* link them quickly, if you dont pay they will pass it onto rms debt collection....
Although not always. I bought two skateboards from RefillSeven in Australia, they never arrived, I never heard back and opened a Paypal complaint. Paypal got back to me saying they hadn't heard back from RefillSeven so have found in my favour but cannot give me my money back as RefillSeven have to do this
ยฃ500ish down the swanny

Help please?!, by GD303uk on Aug 30, 2007 13:38:48 GMT 1, I would ask for the print to be returned let paypal do the returning of the money and try and claim damages from the post, Paypal in the UK are twats and will always side with the buyer in situations like this, I have been in same situation; they will take money from your card details without your permission, If the funds are not in there you will still pay, and incur charges. If you stress too much about there being no or little damage, I wouldnโt put it past this buyer to make the damage worse in order to grantee his refund, Either way get your print back and chalk it up as bad sale, you can always sell the print again, Any chance you can buy of him?? What is their id? You should post it. And I agree with Bongo, If the second mail was unprovoked it does look like they read this forum, There is a hint of a threat in their emails, sounds like a Cunt.
