EBAY HELP FOR RBK, by RBK on Nov 9, 2007 21:54:54 GMT 1, I need some advice from the collective....
I bought a screenprint on Ebay on Sept. 18th. It is a desirable print and I got it for a 'good deal'. I've yet to receive the print.
After bugging the seller frequently for an update, on Oct. 20th I got the following message from the seller: "The post office just delivered the tube back to me today. Apparently they objected to the print and the provenance being packed together as this constitutes an artwork for which more documentation needs to be included. I have resent the print and the prov separately which I am told will do the trick."
Now it is Nov. 9th and I've still yet to receive the print or the provenance. Despite numerous requests the seller hasn't provided any tracking/shipping numbers. That being said - I think he is a member of these 2 forums, has 100% feedback & has sold a bunch of prints.
Am I just being impatient and need to give it another week, or my concern is more than valid?

EBAY HELP FOR RBK, by lesbianwednesdays on Nov 9, 2007 21:59:48 GMT 1, time to get heavy i think robert, not that there is anything untoward more so to give the person in question a much needed kick up the arse. i give people 10 days and then start breaking balls, it usually focuses the mind.
you need to be persistant, people with the best intentions can some times be a little slow to say the least, so don't be shy to hurry them up.

EBAY HELP FOR RBK, by dotdot on Nov 9, 2007 22:03:21 GMT 1, interesting story rbk.
I have yet to hear of a post office rejecting a tube thinking there is prov inside.
I do believe this story to me bordering on fictional. (i.e. you could be being taken advantage of..)
If I was to send you a tube in the us - the prov would , strangely, be inside. I'd have a copy to act as reference in the event of vanishing tube trick.
Whilst i don't wish to tread on people's toes - this seller is in need of a clip if they have failed to talk to you.
Did you pay via paypal - etc ...ie take precautions as it were ?
Keep us posted ..

EBAY HELP FOR RBK, by leehambly on Nov 9, 2007 22:06:36 GMT 1, Not wanting to alarm the frick out of you, isnt this just a scam to elongate the delivery time to ensure the funds have cleared and the complaint time limit has expired? I'd think seriously about doing soemthing quick with eBay/Paypal about this, pronto.

EBAY HELP FOR RBK, by RBK on Nov 9, 2007 22:13:44 GMT 1, I was pretty aggressive in asking for tracking/shipping numbers from the time of purchase up until his response on Oct. 20th. I really don't want to name and shame yet (and ultimately really just want a happy ending with a print in my hand) but I am kinda sh!ting my pants here.

EBAY HELP FOR RBK, by RBK on Nov 9, 2007 22:15:54 GMT 1, I've already opened a 'dispute' with paypal - will be soon making it an official 'claim'
The weird thing is - this seller has 100% feedback and has sold expensive prints (Micallef, Neate, Beejoir, etc)

What do you mean about 45 days???
And I worry the seller wants me to initiate a refund (because it was the cheapest the print has sold for in a long time). And I really want the print - not my money back.

The seller should have a healthy respect for the "oddness" surrounding this then... not sure the postal service have got anything to do with the provenance? Or its determination.
From what I remember about cross-border deliveries (back a few years when I was employed in that kind of thing) the provenance of an item shouldn't be in dispute, the "incoterms" (can't remember what that means precisely, but it defines how the cross-border part should be handled) is supplied by the sender but goes on the outside of the package and frankly has little to do with the actual item, itself (depends on what you are sending though, nuclear, weapons grade stuff etc! you know the kind of thing) - seriosuly doubt it has any relevance in this case, but I could be wrong.

EBAY HELP FOR RBK, by craigf on Nov 9, 2007 22:36:37 GMT 1, I think 45 days relates to the period of time that you can raise a dispute with eBay (45 days from the date of the auction ending). Looks like you are over this already
If you paid via Paypal using your credit card you can also speak to your credit card company and refuse the charge based on the non receipt of the goods

I think you can lodge a dispute for "item not received" at some point between 10 and 60 days after the auction ended (getting very close), but it may depend on how you paid.
Can't say this strongly enough... if the seller is pulling a fast one (either as a scam or as a way of getting out of selling an under-valued item) you can sing all you like for the great price you won the item for, BUT I really would start thinking about recovering your money rather than missing out on a bargain... a bargain on an item that simply doesn't exist is no bargain at all.

EBAY HELP FOR RBK, by Michael Jacob on Nov 9, 2007 22:47:08 GMT 1, Its 60 days in the US. I bought a Chagall print off ebay. It came to me damaged, so I sent it back. I had a terrible time communicating with the seller. He always had a story. Over 60 days went by, and there is nothing ebay or paypal will do. I agree, youve been very patient. I would try one more time being nice. If the weekend passes and you dont hear anything, go through ebay. You can mark it as "not received". I would do that to at least get a paper trail going. Good luck, hopefully its just a delay. I would also check to see if its 45 or 60 for you.

EBAY HELP FOR RBK, by RBK on Nov 9, 2007 22:52:38 GMT 1, Thanks for the advice guys. I've added to my 'dispute' with paypal and will raise to a 'complaint' if I don't have a remedy by Sunday night.
I've also marked the item as 'not received' with Ebay.
Hopefully this has a happy ending (and I'm glad the response wasn't you are impatient & irrational RBK!)

EBAY HELP FOR RBK, by scavos on Nov 9, 2007 23:00:52 GMT 1, Sorry to hear about this rbk.
I would definitely pursue your complaint but continue to attemp a friendly but assertive dialogue with the seller. I'd suggest attempting to getting hold of a phone number and offer yours in the process. Speaking with each other may well be more productive that emails.
I would be clear that you have initiated a complaint as a precaution because of the time delay, but that you fully expect this to be some miscommunication that will be easily resolved. Imply that you fully assume you will get your print as intended, leaving the seller in no two minds that you will take matters further if you do not.
Good luck in sorting this out.

EBAY HELP FOR RBK, by Zippy on Nov 9, 2007 23:23:34 GMT 1, I got royally shafted recently for the first time. I thought I was aware of 'all the tricks' but I ended up with a dry mounted hewlett kid. I only got a tiny % back from paypal. Robert, e-mail me the sellers name and forum name as there is a good possibility I will either know them or know of them. It might be easier for me to help from over here. Also, ebay will give you their phone number. I'm happy to ring on your behalf. Z

I allways believe that it is good practice when selling something on ebay to actually contact the buyer as soon as you post the item with the postal reference number.
Yeah, name and shame too.
All the best RBK.

hardly constructive is it? i'm sure with enough persausion this clown will see sense, at least i hope so.
if we're getting nowhere then i do wonder if letting those you know, what their username is via PM and see what they think. after that and only as a very last resort should you name them in public. it's all too easy for this to become a witch hunt which will do no one any favours and in my opinion, should be avoided at all costs.
